The story of the swim ladder that stuck out 11cm too far from the jetty. Oh no, can’t have that. Well the owner can have it with the appropriate approvals from – BoP Council’s Maritime Team, the Department of Conservation, Fish and Game, Land Information NZ, and Te Arawa Lakes Trust.

Fortunately a consent was issued. Four years later. Cost $1,175 plus rather a lot of time.

Minister Seymour, come on down.

      Every year the “govt” sends me compliance updates, amending my “Quality Assurance Manual” (which I must have to do business).
      For years, it was just a couple of adjustments a year.
      last year there were 50.
      Justifying their jobs?

        Thats Strange mike. There is this rule
        Commission regulation 2257/94 decreed that bananas in general should be “free from malformation or abnormal curvature”. Those sold as “extra class” must be perfect, “class 1” can have “slight defects of shape” and “class 2” can have full-scale “defects of shape.”
        Abnormal curvature and defects of shape sounds very much like bendy.

        Under EU regulations, the ideal cucumber is 30 cm long with a curvature of some 10 mm for every 10 cm. Light curving cucumbers may have a curvature of 20 mm per 10 cm according to regulation No 1677 of 1988

  There’s a restriction. It’s there for a reason. Several reasons, it would appear from the number of agencies involved.
  And so there’s a line. Yes, like all regulated lines, it’s a bit arbitrary. But it has to be set somewhere.
  
  If going over the line by 11 cm is not worth bothering about, why not 12 cm? 13 cm? A metre? Three metres?

    I have an answer. In law, there is what as know as the de minimis rule – loosely translated, it means “the law does not concern itself with trifles”
    
    In practice, it means you are most unlikely – if the shop was stupid enough to make a complaint = to be prosecuted for plucking one grape off a bunch in the food and veges section, and eating it – but you might just be prosecuted if you stole a whole box of grapes.
    
    11cm would – or should in a rational world – fall within the de minimis rule while a metre would not.

      What if it were 99 cm? That’s less than a metre, so is that de minimis? 90 cm? 72? 37? Which of these is de minimis and which is not?
      
      All you’ve done is add another line that’s arbitrary, untransparent and subjective, to a line that’s arbitrary, clear and objective.

    Well there is the reason the council issued the default notice in the first place. Was a jobsworth travelling around the BoP measuring this that and the other and comparing to the consents? Maybe there was a complaint?

      Either you have a rule and you monitor for compliance and enforce it, or you don’t have a rule. Which is better will depend on the circumstances, but in any circumstance having a rule and then doing nothing to check whether people are complying with it is worse than either.

      I too have an example
      Several years ago a council inspector, came to inspect my carport, for it’s “final” sign off (for safety reasons, he said)
      The carport had be built and signed offv by the builder (awaiting council inspection) 5 years earlier.

      It is a ratchet system that is destroying the west. Always more regulation never less.
      
      Pervasive pathological safetyism driven by a predominantly anxious unthinkingly ’empathetic’ mindset that brooks no dissent lest critics look ‘unkind’ and suffer career setbacks etc.
      
      It is not subject to sensible and necessary assessment of cost/benefits which results in ever increasing reams of regulation that impose cost without useful benefit. It relentlessly grows bureaucracies and the cohorts of compliance employees needed to appease their dictat.
      
      All these people getting rich off the regulatory waste are then clamorous for more of the same to increase the extents of their empires.
      
      Its the reason why we can’t affordably build or maintain infrastructure anymore, and a large part of why housing has become unaffordable and why our country is languishing economically.

Her burbling about temporarily leaving the Green Party to prove she was not political was nonsensical. She didn’t seem to need a break in the interview but would have been better if she had. She thinks it will be hard to get re elected but believes she can convince Wellingtonians she’s good for the City. !!!!. Say no more. JT was soft as.

      If you want 10 minutes of entertainment that even John Clarke would struggle to match watch Jack’s interview with Tori on Q&A.
      The scary thing is that this was Tori answering questions when presumably sober.
      “We will not achieve a majority vote in favour of selling the airport shares”
      “We will not be able to pass our long term plan”
      Followed 5 minutes later by the complete opposite of both.
      At then the flipflops on reasons (that she herself raised) for selling her car.
      You get the feeling that Tori thinks that if she says a few maori words then no rational or logic is required in anything that might come out of her mouth.
      Between herself and Kiri they have done a disservice to the reptutation of Maori women holding public offices.

  I think the selectors have pretty much got the right squad. Something appears to be off in the approach, especially after the reserves come on and during those dreadful final quarters.
  Problems with leadership and ‘game management’. Scott Barrett has had a disrupted season, and it’s harder to lead when not playing that well. McKenzie will always be a bit erratic, but I don’t see any change being made there this year, at least.
  As for the media, they depend on access, so it takes major dissension in the ranks for anything very critical at all to come out. Robertson has the media on his side now, as he did when the previous coach was being undermined. Even a disastrous northern tour won’t change that, still 3 years from the RWC.

    Mackenzie is the problem, 3 tries ruled out, he was at the forefront of why all three were ruled out, the sooner he is gone to Ireland or where ever he is going the better, let’s not forget Mounga will have finished his second year of Japan rugby in Feb next year, he will be fast track back and possibly put into the Crusaders with a miraculous injury to someone early on

  I dunno, if Damian McKenzie is the answer as the All Blacks No, 10 then it must have been an (expletive-deleted) stupid question.
  
  Two more yellow cards…
  
  (Wasn’t Razor brought in to, amongst other things, improve on-field discipline?)
  
  And a head-high tackle right at the end that I‘d have doled out another yellow for … leaving the Ocks with a last-ditch attempt at what might well have been a famous win.
  
  But – heavy sarcasm follows – at least the haka (yawn!) was well done…

    Biscuit good 10’s are in short supply because BB is not the answer. Maybe try Plummer there.
    
    There is a need to sort the midfield too – Lienart-Brown and Proctor deserve another go starting with Ioane back on the Left Wing. If fit both Barretts on the bench.
    
    Not much room to move in the forwards except perhaps Blackadder at 7. Hopefully Taukei’aho will be back soon too because he has a bit more grunt than Aumua.

      Perhaps the All blacks should take a leaf out of South Africa’s playbook and establish their own bomb squad.
      Save up some of the toughest players and put them on in a group with 20 minutes to go.

        Gravel – I think there is an element of that but it is not yet working.
        
        BB is one of the two best bench players in world rugby (Marx is the other) and maybe with Jordie and Hotham also on the bench it may work in the backs.
        
        Forwards are problematic though with Finau and Aumua disappointing. Maybe start Darry and have Vaii on the bench and of course Taukei’aho will be back some time. That might add a bit of ooommmph.

  Turns out that a winning record when coaching Canterbury and the ability to breakdance are not the predictors of excellence as an All Blacks coach that some people thought they were.
  
  Based on my lifetime of watching the ABs, the strongest predictor of an effective coach would be not being a former player.

    I think they’ve always been former players, just not always former All Blacks. Brian Lochore perhaps being the exception of a great AB player becoming a great AB coach. Of the nine head coaches since Lochore, 5 were former ABs.

    Early days NK once he stops being `Foster lite’ and picks the best players in their best positions things will improve.
    
    Although Perenara did very well defensively the go forward ball was cleared so slowly once he came on – Hotham would have been a better bet if Ratima needed replacing. Surely 22 year olds can play 80 minutes these days.

      Permits will be off the bench in his last test next week, he will not go on the end of year tour due to retire this year, the top half back will be back with the ever improving Ratana and Hotman the three half backs, also Fakatava is waiting in the wings, he is not far off

        I’ve never been that impressed with Fakatava, now that he’s behind Roigard, Ratima, Hotham and presumably Christie the only way he’s getting back in is a freak run of injuries. Not sure how old he is, but if I were him I’d have my agent making late night phone calls to Europe.

      Robertson is the most successful Super Rugby coach since the competition began.

    He’s coached 8 games Nigel. Are you seriously basing performance on 8 games? And he has won 5 of them. Sure, he set high standards with Canterbury, Crusaders and NZ under 20’s. You don’t win 80% of those games by being hopeless. Otherwise Foster would have done same.

  That report makes an argument that most of the 1 billion or so Muslims in the world are not violent.
  
  But many of them celebrated wildly when the twin towers were bombed and when Hamas operatives crossed the border into Israel on 7 October 2023 and burned babies in ovens, and raped and killed many women, old and young alike.

  Chuck: That Steyn fellow articulates exactly what I have been saying on here for years – if we don’t push back, and push back strongly – we will find ourselves dictated to and our freedoms heavily curtailed by Muslims.
  
  And in answer to the inevitable naive comments from newbies “But Muslims cause no trouble here” the answer is “There are not yet enough of them to be bold enough to try. Two percent is the first ‘tipping point’, and our Muslim population is only about 1.5%”

Media moment of the week.
TVNZ news item on an elderly Otago Uni professor calling for media ban on fast food advertising on TV, ‘cos too many youngsters are obese.
Item propped up by street interviews of well-dressed middle-aged dowagers saying ‘100%’, absolutely’, something must be done’ etc etc.
The last lady, somewhat less affluent than the others from her appearance, but obviously more connected with kids, stuck a pin in the whole item.
‘Nah, kids these days don’t watch much telly.’

So true. Brilliant.

And there it is again. Herald on Sunday reports “many people in part blame the cost-of-living crisis driving ever busier lives ” as the reason less sit down to dinner together.

It’s the “ever busier lives” bit. Media have been dragging this one out for more than 2 decades. You can’t possibly have significantly continually ever busier lives over decades.

While I’m on it, crisis. Can a crisis run for more than a couple of years? Like all the other crises we have at the moment. I thought a crisis was something for which an immediate decision was needed, a rapid turning point if you will. If it’s been going on for a long time and no-one is dying in a ditch, isn’t it just the status quo. Admittedly an unpleasant one in this case.

  Some would criticise him for that but I reckon he could be onto something. Some issues are better dealt with by not confronting them directly.
  
  If you provoke a direct confrontation on this kind of issue you must win. Seymour has already lost. He let the media frame it as an issue of race. Game over, he loses.
  
  Framing is everything. Once the media framed this as a racism issue everything Seymour said was dismissed as intellectual sophistry and the excuses of a racist. There is no way to win that fight.

Back in the 90s I started a small retail business in a provincial city. A sandwich board on the footpath seemed like a good idea. Wasn’t long before some “official” from the council arrived to say that it was not allowed…potential hazard to pedestrians – particularly sight impaired persons. However it could be there if an annual fee was paid to the council.
Paid their fee and the board remained there for several years, without any pedestrian incidents.

    Oh dear, here I am agreeing with Mike, unfortunately bylaws do have a place, in this case, without them the footpath would became an obstacle course as each business pushed the boundaries to force more foot traffic into their store.
    I can see some businesses placing obstacles forcing foot traffic either into the street or into their store, given the opportunity.

  Flossie: What a disgrace that council was! I had a similar battle with the New Plymouth District Council back in the 80’s
  
  My first house had no garage, so no vehicle crossing. I built a garage, and then enquired about the cost of a vehicle crossing – which had to be made by the council’s designated contractor, who just happend to be my flatmate. The crossing cost the ratepayer $650 – a tidy sum in 1984 – but Brian the contractor only got paid $350 per.
  
  My first step was to have two “plates” made which allowed a car to drive smoothly over the kerb, onto the footpath, and thence onto the property. Some council wallah removed them, scrawled “illegal” across the bottom, and threw them on my lawn.
  
  I re-installed them – but this time dyna-bolted to the road with the threads damaged so they couldn’t be easily removed. It took them a week, but finally they removed them again.
  
  I then conceded (partial) defeat, and instructed Brian to make me a vehicle crossing, for which I would pay him the same amount as the council. He agreed to do it, but only if I didn’t disclose he had built it (he wanted to keep his lucrative contract). He warned me I was going to have trouble with the council – and I did.
  
  Long story short – after threats of litigation – Garrett 1 – NPDC nil.

  We use a non council bin, costs about $10 a week and pick up has been the same day of the week since 2002. Everything goes into it because a few years ago our recycling was not picked up 3 weeks in a row so bugger them.

    We have 4 bins. Garden food scraps is weekly. Then the glass bin, household rubbish bin, and the recyclables are each fortnightly. Then there are all the rules that go with the glass and recycle bins. Oh and now if you break the rules, your bin will get a white lid put on it to advise the truck driver not to empty it. Each bin also has a radio/gps tag on it so that the truck can identify the bin is with the right property and not stolen.

        In Dunedin they now have Rubbish Cops checking the bins with a threat to de rubbish you.
        
        From their website ;
        
        “The recycling bin inspectors will make follow-up checks, leaving letters with advice. If, by the third inspection, a property’s bin still has a high level of contamination, the recycling bin will be removed and the service will be suspended for three months. After that, the service will resume, but the householder will be required to pay a fee for handling and delivery of a new bin.”

      We have all of that (four different bins) plus we have to pay $8 for a tag to go on the General Waste bin in order to have it collected. Nevermind the charges we’ve already paid for this service in our rates bill, And huge problems with tags going missing (nicked?) and rubbish therefore not collected.

  If he has a rubbish app he has a smart phone. A smart device with a calendar, which allows you to enter recurring events.
  
  In the event that a bin is damaged which might be a 1 in two decade event, you phone the council.
  
  You put your bin on the specified day, before the specified day, and it is picked up like clockwork. If the council screw up that, their processes are flawed, and an app just introduces another process that can be flawed.
  
  And if said reporter is that dumb that he cannot figure out how to use a calendar on his smart phone, and is unable to use his said smart phone to make calls, why would you trust anything this reporter writes?

    We have a calandar on the wall – big squares too and every meeting etc goes on it.
    
    We flip it over on the 1st of each month and update it.

      To read a calendar I do not have to remember a password that is at least ten characters long and includes upper case and lower case alphabetical characters as well as numeric characters and at least one symbol that is neither alphabetic nor numeric.

    Actually the drop in real GDP is a lot higher, as the way GDP is measured is not solely about production. Govt spending also figures in the total.
    
    Despite falling, GDP was artificially boosted, softening the fall, by the rampant printing and borrowing, which also masks the closing of businesses, loss of jobs, and contraction in farming.
    
    No different to seeing your next door neighbours with his and her new cars, new jet boat, mobile home, new tech gear, etc.
    
    They may no income (production) increase, in fact they may have lost their jobs, but just lots of debt and credit card bills.

Dairy farms disappearing in the United States …

More than 60 per cent of milk in the United States comes from farms with each more than 2,500 cows.

Dairy farms have been growing in size in NZ, too, but the American consolidation is dramatic.

From 1970 to 2022 the number of producing dairy farms in the United states fell from 648,000 to 24,470.

This article from “Wired” magazine says one of the ways Americans can help their dairy farmers is to buy direct from farms.

  The US dairy industry is highly subsidized and industrialised, meaning that the profitability per cow increases with with herd size.
  
  According to some recent data, per-cow profitability is between 3x and 5x on farms larger than 1000 cows.
  
  “The most profitable parts of the U.S. in 2020 will be the Northwest and Northeast, but smaller farms in those regions won’t participate in this success. On average farms with less than 250 cows will make just $125 to $170 per cow in 2020, while those with more than 1000 or 5000 cows will earn about three to five times that level.
  The least profitable region is expected to be the Southwest, and farms below 250 cows are expected to lose money in 2022. The Southeast is close behind. In both cases farms between 250 -1000 cows will make about half the income per cow of their neighbors with over 1000 or 5000 cows.”
  
  When adjusting for inflation, the retail price of milk is falling due in part to to industrialisation and huge subsides. USA milk is around $4US/gallon = $NZ1.50 a litre. If it was inflation adjusted from the 1995 prices ($2.80/gallon) it would now cost $5.80/gallon ($NZ2.20 a litre).
  
  The only way to reverse that trend is through people being prepared to pay small farmers more to un-tilt the playing field. To do that they would need to pay a lot more to make up for the subsidies etc.

    In NZ people pay much more for less industrial milk that is actually just milk.i pay $4.50 for a litre glass bottle at my local, bottle returned to get that price. Milk has cream on the top and tastes like it did 30+ years ago.
    
    Others pay $7 for a 1.5 litre at the super if it’s organic or otherwise unadulterated.

    It is common for the reasonably wealthy Brit to have a holiday/retirement home in Europe or elsewhere. This is quite uncommon in USA.
