Tikanga law criticisms ‘antiquated

As MPs consider whether to block regulations requiring law students to learn about Māori customs and rules, groups say understanding tikanga is an important part of legal practice

The council had decided to add tikanga Māori to reflect its increasing relevance to the practice of law. While Judd had been critical of the Supreme Court’s Ellis decision, the council could ignore such decisions when deciding what courses should be compulsory for prospective lawyers.
In a supplementary submission to his original complaint, Judd took further aim at public speeches made by Supreme Court justices about decolonisation and tikanga, alleging they “clothe with legitimacy actions to take power and control away from our democratically elected parliament and our democratically constituted government and to put it somewhere else”

Having destroyed Peter Ellis’ life, on his death there was still a humane duty to clear his name and, as I remember the initial reportage, it seemed “tikanga” and specifically the characteristic of “mana”, was mentioned as a supporting argument in addition to that of common decency and justice in continuing restoration of a ruined reputation?

Is it not a further insult to Peter Ellis’ memory, that activists have seized on the “tikanga” comments to implement an agenda that is as unacceptable as quoting in the same context –

Aisha reported: A person who passed away was mentioned in an evil way in front of the Prophet, peace and blessings be upon him, so he said, “Do not mention your deceased unless it is good.”

– because the corollary is that unless his reputation is restored, you should not mention him.
That is not full justice either.

    Common law is not the same as common sense. Common law is simply the accumulation of judicial precedents, some dating to centuries ago. It is endlessly flexible as outdated precedents are discarded or modified to suit new circumstances.

Political Tragics like me may have watched “The West Wing”, Alan Sorkin’s fictional account of the management of the Office of the President.

A story arc of the 2nd and third season was the decision to not disclose a diagnosis of Remitting/Recurring MS of the President, and the ethics of keeping that a secret from the public, and even a secret from most of the senior staff.

The speculation that Biden may be suffering from Parkinsons is an interesting example of Life imitating Art. In fictional West Wing, the President came to the conclusion that is was unethical to withhold the information, and it was publically released.

I wonder if the current senior staff have the same level of candour. It saddens me to say this, but I don’t believe that they do.

The health of Candidates should be a matter of public record, and it seems there is far too much obfuscation taking place.

  I gotta say that I support the g string ban at the Todd Energy Aquatic Centre in New Plymouth. I go there regularly with the kids and it is very disturbing. The stuff article relayed the story of one attractive woman who was asked to leave. I’ve never seen an attractive woman at that place and most of the women wearing g strings are 20 stone plus. If they enforced it 50% of the women would be thrown out of there. In the Naki we call them “obeasties”. I got nothing against big women but it would be nice if they ditched their g strings and covered up a bit more. I’m sick of throwing up in my mouth and having to swallow it so as not to dirty the pool.

As a father myself, this article really upset me. A father set fire to his house and internationally tried to kill his wife and his children. He intentionally threw the children back into the flames and some of his children died.

Many years ago I studied English at school and quite enjoyed the subject. Years later I realised I had had the good fortune of a run of excellent teachers who had exposed me to a great chunk of the literary Canon of the English language.

Years later I felt sorry for my daughters who studied a much reduced field of authors and poets in their senior English classes… one of them entirely restricted to NZ writing.

So I will be interested in what the new senior English Curriculum offers up….
Perhaps a wide field of writing… or perhaps a jumble of fashionable ethno-socio “correct think”.

  I feel that my cohort was really let down in the English department. I was at high school in the 1980s, early years we read some reasonable books, Anne Frank and so on, but the later years we were forced to consume almost solely NZ and Maori authors (the exception being Margaret Atwood) and that put me off for good. IMO at the time, Patricia Grace, Witi Ihimaera, et al produced the most BORING, turgid load of crap (and as a result i’ve never gone back). On the side I read the American classics which I heard about through general Americana of which they are such a key part – everyone in the US grew up reading Gatsby and To Kill a Mockingbird. Not to mention the English or European classics. You would have thought, in NZ in the 80s, that Shakespeare was the only English playwright ever. We were ripped off. I hate to think how much further it has sunk by now.

    I went from reading several books a month at the start of high school and by the end, I did not want to pick a book up ever again.
    
    5th form we were forced to read Patricia Grace, in 7th from we were forced to read a bunch of stuff that our entirely female English teachers thought was great but certainly did not resonate with any of the boys in the classes, and certainly nothing written by a man was permitted.

  Knowledge of a relatively small set of books by specific authors used to be a marker for education. A class identifier for the club of ‘educated’ people. It had it’s time, but now it’s dead.
  
  The world has moved on, university level literacy has exploded into being the norm rather than the exception and that particular club, with all the tedious critique and reference and allusion to classical history and long dead social mores no longer holds any value to kids prospects because it has stopped being a common set of cultural references.
  
  There is now far more valuable and entertaining knowledge to fill your heads with and enormously greater variety in easily accessible high quality literature with settings more relevant to modern existence. Aside from which reading books is dying out as a recreation due to social media etc.

      Reading an economists thesis was a real eye opener.
      Much of the written text was numeric.The message and conclusions were basically numbers, equations and associated numeracy.
      The economist said that figures were much more precise leaving no room for misinterpretation.
      I suspect that other professions use this method for clarity and certainty.

        It should be a condition of academic theses that they are able to be interpreted by the common man.
        The reasoning, whether it is
        numeric or physical , chemical ,or biological should be presented in a manner that enables the reader to follow from hypothesis to conclusion.
        Otherwise, the work becomes a file in a university archive instead of a revelatory document for the benefit of everyone .

      Language and culture and critical knowledge bases change over time. We would be regarded as knuckle-dragging idiots by C19th academics for not being able to quote 100’s of lines of biblical verse, or having the ability to converse in French and Latin.
      
      But the fact is that almost half the population is now getting tertiary education, and are attaining much higher levels of literacy as a result of 5-6 more years in education. 50 years ago only a few percent got that amount of time in education, and while a lot more people read recreationally, much of it was pulp fiction shite, mills and boon etc.

France is going to be a basket case. From the Telegraph

Compared to the U.K.’s election, France’s was certainly a shock. With the final votes tallied, Le Pen’s NR and its allies won only 143 seats in the new Parliament, President Macron’s Ensemble secured 168, and the New Popular Front won 182. Although the NR won 37% of the votes, far more than any other party, tactical voting in a two-round system meant it was locked out of power. Here’s the problem, however. Blocking Le Pen also meant handing a huge increase in power to a New Popular Front dominated by Jean-Luc Melenchon’s France Unbowed. And ironically, it is even more extreme than the NR.

In reality, the Popular Front’s manifesto makes Jeremy Corbyn look like a moderate. It promised 150 billion euros in extra public spending, increasing public sector salaries by 10% immediately, making transport free and lowering the retirement age back to 62, with longer term plans to hire more teachers and healthcare workers and invest more in green energy. It would pay for all of that with higher corporate taxes, with a wealth tax and by borrowing more money.

The NR had plenty of plans for spending more money too, and had nothing to say on liberalising the economy or restoring its competitiveness, but the Popular Front is far more radical. Indeed, an analysis by Bloomberg showed debt as a percentage of GDP rising to almost 130% by 2027 under the Popular Front, compared with 120% for the NR, and 110% under Macron’s outgoing Government.

    One natural disaster can shift that number for us significantly. The CHCH earthquakes, didn’t they increase debt % by double figures?
    
    And in addition to being on the seam of two tectonic plates for EQs and volcanic activity, as a country living in the middle of the ocean, not part of a large continent, nothing is more certain than extreme weather. So we need a significant buffer that other countries do not.

      The Chch EQ actually helped NZ survive the GFC a bit better.
      
      Most of the insurance costs to cover the EQ were underwritten from overseas so all that damage resulted in a huge building/tradie boom that was powered by money flowing in from overseas.
      
      This gave JK a bit of a boost for the “rockstar economy”.

        So, the higher the public debt to GDP ratio the greater the proportion of national productivity is spent servicing debt, and this limits (or should limit) spending on public services e.g. hospitals, police, trans-activists taking story time at the local library.
        
        Of course in practice, socialists drunk on OPM simply fire up the money printers which leads to inflation that hammers their supposed constituents and/or they take on still more debt to pay for all manner of profligate spending.
        
        All of which leads to a worsened debt to GDP ratio. Rinse and repeat.
        
        Need more? Try spending on your credit card and not paying it off. Do this for a few months and see what happens.

So as an average New Zealand man, thinking of the Green Party and who’s out there looking after your interests and concerns … Ricardo Menendez March is your main representative. Not exactly someone to be pinning your hopes on, I would have thought …

A trans-gender problem …

Detecting prostate cancer in some “transgender women” is bring made difficult by the hormones used in gender transition.

Apparently the prostate gland is retained in transition surgery.

Detection of cancer in the gland by PSA tests can then be skewed down by hormones being taken.

Many, many of Kiwiblog’s followers are guys in the prostate-cancer age danger zone, and will be familiar with PSA tests.

We are not going to meet our Paris obligations. The only way it could possibly happen is for our government to basically ruin all our lives and impoverish us all. We’re probably clever enough to vote out any government that starts trying to do this. That might be what Powers meant when he said that degrowth will be a hard sell.
So then, why do our governments come up with nonsense like these 5 pillars that Simon Watts introduces to us all? Are they just trying to buy time while they wait for the house of cards to start falling down?
Ooh, hands up who thinks adding large amounts of wind and solar to our creaking electricity grid, and forcing industry and transportation to impose huge extra demand on it, will _decrease_ our power bills?

A blow to development of Marsden Point, one of NZ’s best deep-water ports.

The port wanted to reclaim 11.7 hectares of land for container handling and a 250m wharf extension, but the Northland Regional and Whangarei District Councils have rejected the proposal.

The Northern Advocate report says local hapū Patuharakeke, which is strongly opposed to the eastern wing expansion, says some cultural issues are “still outstanding”.

It seems the port company is also seeking permission under the Government’s fast-track consenting regime. Will the council’s blocking of the main application affect this?

Decriminalising drug use in Vancouver has been a disaster.

In April, David Eby, British Columbia’s Premier, announced that halfway into the three-year trial, the province would recriminalise drug use in public spaces.

With a severe backlash from police, politicians, and the public showing no sign of abating, Eby is now under pressure to scrap the pilot scheme altogether.

This links to a stark and near-frightening portrayal of drug hell in Vancouver, which used to be one of loveliest cities in the world. I think it’s outside the Telegraph paywall. It’s well worth a try:

      But if a 40+ year old women can defend herself for 7 minutes and 45 seconds against a knife wielding assailant and survive you have to believe that the assailant was not very competent and your chances of survival would be very good.
      
      I would have a hard time watching this and not doing something to try to stop him. With both her and you going at this man I would think that your chances of success would be very good. Other people might also be emboldened to assist when they see they are not alone.

  I do agree, the shortages do put stress on the system and risk people’s lives. But, this is not a new problem, this is a problem the government inherited. I remember a few years ago talking to a district health nurse and finding out how over worked, underpaid and short of staff they were.

    I hope I am not inappropriately hijacking your thread Ghost, but – I know of 14 other physicians ( I am not counting the nurses who are also in my circle of friends and acquaintances) who cannot not work again for the New Zealand healthcare system because of our stance on the Jab of Death and Damage – so we cannot get a practising certificate.
    
    As long as Reti & Co do not address this, they can’t be serious about wanting to staff our hospitals to appropriately meet demand.
