Today marks 116 days of Darlene Tana essentially occupying a Green List Seat under false pretences.

To put that into perspective, The Parliament Grounds Occupation was 23 days.

The Moutua Gardens Occupation was 79 days.

  If Tana remains in parliament this will further embarrass the Gweens. Gweens might even have to show NZ how much Gween principals are worth by using waka jumping crap.
  
  MSM is now basically working hard for the Gweens pouring as much shit on Tana as possible to force her out instead of the Gweens having to fire her.

    I was opposed to the ‘Waka Jumping’ law. More properly section 55A of the Electoral Act 1993.
    
    I have changed my mind. I don’t think that electorate MPs should ever be able to be forced out of parliament by their Party. List MPs are effectively a product of their parties. If the Greens don’t trigger the law, they can wear the consequences.

      The ‘Waka Jumping’ law does not apply here or does not need to apply.
      
      Chloe has fired her from caucus. If she wanted to get rid of her, all she has to do is remove Darlene Tana from the Green Party List.
      
      At that point, not being an elected representative or on a party list, she is a gone burger. Greens have 15 seats in the house, but only 14 MPs listed on the Greens website.
      
      So Darlene Tana is still a Greens MP, but not part of caucus. The long delay in Swarbrick and Davidson doing anything tends to suggest 2 things:
      
      [1] That they don’t see anything that much wrong with what Darlene Tana has done, but for the sake of optics they have imposed a penalty and perhaps may bring her “back into the fold” later.
      
      [2] However, Darlene Tana response to the report is telling. She rejects it outright. She can’t be an independent MP, as she is only in Parliament on the Greens list.
      
      So either her attitude is all part of the optics and charades.
      
      OR:
      
      Darlene Tana has probably said that if she goes down, that she will take down Swarbrick (and Davidson) down with her, or release information further damming to the Green Party.
      
      Unless of course Swarbrick (and Davidson) simply do not have the backbone to be brutal and remove her from the list.
      
      But I suspect that given the makeup of the Greens party, and the shit that has gone down with GG and others, that there is more dirty laundry to be aired, unless Tana get what she wants.

        There is another possibility: Tana joins Te Pati Maori, and the Greens demand another List MP, to bring them back to 15.
        
        All of which means the Left gain another seat.
        
        I wouldn’t be at all surprised if Tana, the Greens and TPM aren’t already colluding to this end.

        No you are wrong. If the MP won’t resign from parliament, the only other lawful way she can be removed from parliament is by invoking section 55A of the Electoral Act 1993.

        No it does not work like that. There is no such provision in the Electoral Act.

        Darleen Tana is a free person living in a free society. She can do whatever she likes, within the law, including resigning from one political party and joining another.

      Certainly electorate MPs should not be forced out of parliament. They are elected by the voters in their electorate. The party does not own them. They are owned by their constituents.
      
      Yes, the case could be made that a member was elected under the umbrella of the party and when they cease to be a member of that party they lose their warrant, so to speak.
      
      But when an MP resigns for a party or is dismissed by a party, they become an independent and I think they should be allowed to continue until the next election. But they should not be allowed to represent another party which I always thought was the fundamental reason to have the waka jumping law in the first place.

        How do you stop National MPs voting with Labour? In fact they’re going to do it over the bailout for the media with National picking up Labour’s bill and the two parties voting for it.
        
        When you’ve got complicity and corruption like that I hardly think a Green MP voting with TPM is an issue. Hell, the Greens and TMP are so closely aligned on most issues they might as well merge.

        Tana is 13th on the Green list. She is not an elected MP.
        She stood in the Tāmaki Makaurau seat and did not make it against Te Maori Party.

    Simon Bridges was not prepared to use the Waka Hopping laws against JLR for similar reasons to the Greens not wanting to use it. Also Simon considered that JLR had a good chance of successfully challenging any attempted removal in court.

        Simon Bridges (or his firm) had a Crown Law warrant for the Tauranga area (I think). In that role he would have acted for the Government on both civil and criminal matters. He would have done the more serious prosecutions on behalf of the Police and other agencies eg IRD. The Police however handle minor prosecutions themselves but their prosecutors are not lawyers although some study law on the side.
        I suspect Simon found deficiencies in the Waka Hopper bill when introduced in 2018 but kept quiet (and continues to keep quiet) about them.

    Absolutely agree NK ,MMP has created an anti democratic system where party bureaucracy selects people in a governance role without reference to the ballot box .
    New Zealand voters have been disenfranchised.
    Example :a Green MP achieved substantially less than 20% in her electorate, entered parliament on the list and was given a minister’s portfolio.!
    This is not democratic .
    This and similar is a substantial cause of the troubles troubles afflicting NZ today!

      It seems to me, under MMP democracy ends as soon as the votes have been counted. After that the party bosses get together & decide which policies they will keep, who gets which position, & who will run the country. I think the Australian STV system is better. At least all candidates are assigned an electorate & the voters get to eyeball them.

        The “Australian STV system” is the Majority-Preferential Vote (PV) in single-member electoral divisions. The only improvement over FPP is that the winner in each division requires an absolute majority of the votes to win, not merely a plurality, i.e., receiving as few as one vote more than any other candidate.
        
        In my view, we are not going back to FPP (nor will we ever adopt PV). If we abandon MMP at some point in the future, it must surely be to adopt STV in (large) multimember electoral districts.

    Is there actually a reason why we can’t have a law that specifies that List MPs serve at the pleasure of their Party leader/caucus and that if they resign from their Party or are expelled from it, they are no longer an MP?
    
    Electorate MP’s are voted in by their electorates; if one leaves, a by-election can be held to choose another.
    
    But List MP’s are there to make up their Party’s share of the vote and the public voted on the List with its Party vote. So if one leaves, the next on the list should replace them.

      That already exists in the form that MPs are either elected or enter in on the party list. It is a given that if those conditions are no longer met, they cannot be in parliament. This can happen by losing a by-election in an electorate or being tossed off a party list.

  If she was no longer on the list, she would have been replaced. She probably knows where the bodies are buried or which Green (MP) was in Scotties when GG was helping herself, or one of a number of other “self help ” activities GG was involved in.

      If she goes off the Green list, she is replaced by someone else on the Green list. That is how MMP works.
      
      If you get thrown off the All Blacks list, you are off. You can’t rock up to a Rugby test as an independent.

Here’s another immigrant exploiting newer immigrants; not the first time either. I should add that the story doesn’t state that Jafar Kurisi, aka Tauranga Ali is himself an immigrant – call it a wild stab in the dark on my part.

You would think that Tauranga Ali would be outski, but no. In fact, he dodged prison and was given time off HD for his early guilty plea, reparation payment and also for his ill health and age (60!).

No doubt he’s an NZ citizen. I also have no doubt that he was not a person of good character when he applied for residency and citizenship, though he would have claimed to be. Therefore, in my view, NZ retains the right to strip these off him.

    I can’t be bothered reading the judgement. However this person promoted herself as “New Zealand’s Dr Fauci”. It was a personal choice. She waded into the most polarising issue of a generation.
    
    Of course she was going to attract vitriol. Her appearance with the pink hair made it worse. Yes that is unfair but she lives in the real world
    
    Also, is she in the top 10 best qualified New Zealanders to comment on a pandemic? If not why did she promote herself as the go to expert, every day at one point? Have I got this right? If Darleen Tana does not resign and if the Green Party does not invoke the Waka Jumping Act she could remain as an Independent MP representing nobody except herself.     It depends how relevant the ‘wrong’ findings are in the big order of things. If the report was found to be significantly wrong on key aspects then the Party could re-admit her as a member and the caucus re-admit her. She would then be able to e a candidate for the Greens in the next election. However she would have had a chance to correct any factual inaccuracies before the Report was issued to the Greens leadership. She would be dreaming if she thinks that the main facts and conclusions in the Report are wrong.
    She could seek judicial review if her readmission to the party or her candidacy nomination were declined.
    Roger Payne a National wanabe candidate took the Party to court in 2008 and succeeded to have a selection meeting put on hold pending hearing of his case. David Farrrar then National Party electorate chair vetoed his party membership application as being unsuitable (with good reason). He subsequently moved south and succeeded in joining the Party in Canterbury. He then put forward a nomination for the Selwyn seat, but the National Party Board vetoed his nomination (also for good reason). He took the Party to Court and the Court held that the Board was democratically elected by members (via delegates) and the Board was entitled to exclude his nomination.
    So in Darleen’s case, as long as the decision making group was democratically elected/appointed within Party rules and there were reasonable grounds for the decision (a low barrier would apply) Darleen would e very unlikely to be successful in seeking any judicial review. So the Party could make things difficult for her in 2026 by giving her a low list ranking and allowing her to e a Green candidate in a hopeless electorate.
    However Darleen could have more success seeking judicial review if she challenged any removal from Parliament under the Waka Hopper law.

  This is very poor quality “research”. No randomization (participants are self-selecting), and based on subjective perceptions of racism – apparently, not saying “kia ora” is racist. Neither is there any control group, as they didn’t ask Kiwis of European or Asian descent about their experiences of “racism” or bullying in the health sector. My sister trained as a doctor, and says she was bullied – she’s white. It’s clear that training to be a doctor is hugely stressful – not for the faint-hearted, irrespective of ethnicity.
  
  But now the article has been published, it will be held up by activists as “proof” that the health system is racist, and must undergo further “indigenization” etc. This is how the academic publishing industry is complicit in the ideological capture of institutions. It’s called “idea laundering”. But what editor would dare risk accusations of “racism” by rejecting such a flawed piece of work?

But that token acknowledgment will be completely disregarded when this study is used by pressure groups to try to force further indigenization of the health system. They care about power, not truth. There is a stoush brewing over a Ministry Ordered closure of a rural Early Childcare Center in Manawatu.

It’s not about safety, even though this Kindy almost operates as a farm, and allows the kids to experience a bit of rural life, including feeding animals. The Kids are safe and happy.

It’s about the cirriculum. The Ministry is seeking to close this center because it hasn’t, in their view, addresses concerns raised with regard to establishing “culturally responsive practices throughout the centre curriculum”; ensure te reo and tikanga Māori were valued and integral parts of the curriculum; and develop understanding of effective internal evaluation.

      I do hope someone takes a very close look at the Early childhood curriculum.
      
      It espouses the Mason Durie model of wellbeing and asserts that the spiritual nature of toddlers/children must be catered for.
      
      Similarly, the Relationships and sexuality Curriculum of NZ expects teachers to attend to the spiritual nature of pupils/students.
      
      This seems to be in direct contradiction to the Education Act that states education in State schools (i.e. not of special character) MUST be secular.
      
      Our education law requires that teaching in all state primary schools must be entirely of a
      secular character (non-religious) while the school is open.

    It depends on the type of meter installed. With Glo-Bug (or other prepayment meters) power is disconnected automatically if the customer runs out of credit and there is no reconnection fee as such.
    For other customers, their meters may or may not be capable of remote disconnection or reconnection. If not then someone would need to be dispatched to disconnect then reconnect the power. I agree it would be wrong if the reconnection fee was applied indiscriminantly whether or not the meter had a remote disconnection facility. Similarly it would be wrong if the fee was waived where the meter happens to have the disconnect facility. The fairest method would be to set the reconnection fee to the average cost of disconnections and reconnections which would decrease in time as more remote disconnection meters are installed.
    The other main issue here is the one of customers paying on time having to subsidise the ones who do not pay on time. While it could be decreed that retailers support non paying customers out of profits, in time the burden would move from shareholders to the customer base.

    I would imagine they are required to make several attempts to contact the person on the bill. They probably spend half an hour on the phone sorting out a payment plan that never happens, and I’m damned sure they document every decision. I bet the supervisors have to be involved too, it’s not a junior worker decision.
    
    Given the cost of employment now, say $40 per hour for the billing supervisor x2 (employment costs), it doesn’t take long to get to $160, a mere two hours. And then the bill goes to the Debt collector who takes half of what they recover.
    
    Why should those of us that pay our bills pay for this? We already don’t get a prompt payment t discount for paying on time, we already pay the winter energy payment to these people, why should we pay the costs of their disconnection?

Greens co-leader Chlöe Swarbrick is open to the idea of using the waka-jumping legislation to eject Darleen Tana from Parliament.
Tana has resigned from the Greens after the party’s independent review into allegations linking her to exploitation at her husband’s bicycle company.
But she hasn’t resigned from Parliament, and if she doesn’t, the Greens may have to use the waka-jumping rule – a law they hate – to force her out.

At any time they wish, the Greens can say “A greater principle stands in place of our earlier principles”, so the Party is thus shown to be more principled than we were when we opposed Winston’s “waka jumping” legislation”

    It is interesting to see how various societies cleave because it shows the dominant way in which they identify themselves. For example, in US it is Black/Hispanic, in the UK it is class, in Northen Ireland it is religion.
    
    The Greens used to see equity in terms of gender; now they see society primarily in terms of Maori/Pakeha, with gender being a subcategory.

  President Biden may well withdraw his candidacy (or he may not), but there’s no way, in my view, he would relinquish the presidency, as well. You have not yet explained to us why you think he would.
  
  On the other hand, there is no doubt in my mind that were Harris to go into the Convention as President (almost certainly also with Biden’s endorsement), she would secure the nomination. She only needs 1,975 of Biden’s (and, let’s face it, her*) 3,905 delegates.
  
  * On 19 January 2022, Biden confirmed “Harris will again be his running mate in his 2024 re-election campaign.” (See https://www.politico.com/news/2022/01/19/biden-commits-to-harris-as-his-running-mate-2024-527418.) So, people voted in the primaries this year knowing that they were a team, and that she could become president sometime during his second term.

  There is nothing in the article to support your interpretation, that you “Guess they aren’t interested in president kamala taking over the campaign”, meaning they don’t want her to win the nomination. All they are saying is that they want an open convention in the event that Biden withdraws from the race (as would I).

  Well it would be a start, but….
  *No matter the format, batteries still need to be charged.
  * There is already a problem with battery damage happening at a huge scale. Moving to a rental model for batteries is likely going to end up with people taking less care and thrashing batteries (eg. driving over rocky roads, over kerbs etc).
  
  Batteries are often a part of the structure of the vehicle. To make removable batteries could require adding significant extra weight etc.

    Why would it be so hard to have swappable batteries in a car ? We have them everywhere else.
    Maybe there are vested interests to prevent this for some reason, even for a few years more.

      Greybeard, the average weight of an EV battery is 454 kg. Long range EV batteries weigh considerably more. These batteries are an integral part of the EV’s structure. Even if there was agreement between manufacturers and all of the models they produce, at 454 kg on average a battery swap would not be as straightforward as your 9kg bottle swap at Bunnings.

  Agree. It would make far more sense economically, and from a safety and efficiency perspective.
  
  Carry 1 or two 20kWh modules around for normal daily commuting, and add extra for long trips or when towing. Robotic swap at a battery station in a few seconds, take out battery for car repairs (a Big issue for EV’s particularly for panel beating and paint baking ovens), battery retains value even if car is written off.
  
  And built in battery monitoring would make it possible to charge more for battery abuse.
  
  Use cheap LiPo or Sodium batteries for daily use, and expensive NMC batteries or maybe even range extender IC engine modules for longer trips.
  
  Could also make an up-front payment for battery use for life of vehicle if idea of ongoing rental charges pissed people off.
  
  It’s technically straight forward (demoed by Nio, Better Place and even Tesla in past), problem is getting sufficient number of manufacturers and users and infrastructure-builders to buy in to idea and roll it out at scale.

  I dare say that most EV’s are slow charged at night when electric power is cheaper.
  
  So EVs are already a viable technology. The number of EVs in New Zealand has increased substantially going from fewer than 1000 EVs in 1993 to about 76,000 by June of 2024. That’s not counting the 30,000 odd plug-in hybrids.
  
  In December 2023 over 50% of new car sales were EVs. Even after the removal of the clean car discounts/rebates over 12% of new car sales are EVs.

On a frosty Christchurch morning yesterday, my 4km commute to the office at the peak rush period had me caught in thick, slow-moving vehicular traffic. I had plenty of opportunity to count the 11 buses that I encountered in that short distance. 4 were completely empty, the rest had no more than a literal handful of passengers – four was the most I saw. There was not a soul to be seen at a single bus stop along the way. I counted two cyclists making use of the expensive, intrusive cycle lanes. Cars seemed to be very popular.

Make of it all what you will.

  “Can’t be identified for legal reasons” can mean a number of things, including that name suppression has been granted for the usual bullshit reasons. It may also be that there are other proceedings under way against him and the name is suppressed to preserve fair trial rights.
