    I heard her this morning on RNZ. As usual a mix of some broadly correct statements mixed in with rubbish.
    
    She was correct, you can’t leave person stateless, but you can remove NZ nationality from a person:
    1. Who was born in another country and who has retained the nationality; or
    2. Who has nationality of another country by descent ie one of their parents was born tin another country and that other country grants nationality to the children of citizens when born abroad.
    
    NZ does not make you give up your original citizenship when you acquire NZ citizenship.
    
    So yet again Ardern was a liar, by being poorly informed!

      IIRC the circumstance where a citizen can lose their citizenship is highly constrained. There are only two circumstances.
      
      1. New Zealand citizenship was obtained by fraud.
      
      2. A New Zealander acquires by a deliberate act, the citizenship of another country and acts manifestly against the interests of New Zealand.
      
      So for example if I bacame an Iranian citizen and killed people in New Zealand, I could be stripped of my New Zealand citizenship and be deported to Iran.

        Srylands, you could be stripped of your NZ citizenship if you act against the interests of NZ (I’ve cued the govt DIA website), is broad enough for you to comment a crime or act of terror abroad for it to be considered an act against the interests of NZ. Giving the Minister of Internal Affairs the right to strip a person of their citizenship.

    Today’s word (brought to us by Jacinda) is “refute”. How many times did she say “refute” during the interview? I lost count after about 10 times.
    
    And, as Nigel Kearney noted, Jacinda doesn’t know what “refute” means:
    
    Someone should explain to her that ‘refute’ does not mean the same as ‘deny’.

      I had always understood the word refute to mean “…proving a statement to be wrong or incorrect.”
      To do so one needs to make an argument that rebuts the argument of another.
      To simply say that an argument is “refuted” without saying anything else carries no weight.

      She will last as leader. There’s no question she has charisma, Labour’s polling is holding up (in defiance of the already apparent negative consequences of their insane policies), and there aren’t any obvious candidates lining up to replace her.
      
      As for being hammered in debates, while I wish that could be true, Bill English had an excellent grasp on details. But Ardern’s one true skill is being able to dance on the head of a pin to avoid answering questions. That allowed her to “win” (or at least not lose) the debates despite being clueless on policy.

        Agreed but I can see a time when she says she’s had enough (worsening health is a possibility) – irrespective of the people imploring her to stay because there’s no one to replace her (Robertson, Parker, Little, Sepuloni, Wood, Twyford, Hipkins – snigger 🙂 )
        
        I can also see that time being sooner rather than later.
        
        There’s another option too. That once her gloss starts to wear off (I argue it’s already started) there will be some in the cabinet who fancy their chances (Robertson clearly, Twyford, Little (again) and possibly Parker – and not discounting some dark horses, including Coffey, who are deluded enough to fancy their chances) and the knives will be out.

It’s there for all to see with Mark Richardson cringing away thinking where are the hard questions rather than agreeing with everything she said..?

  There was another “pathetic soft interview” by Susie Ferguson on Morning Report, she asked Jacinda about the Reid research poll that had 53% against the CGT, so Jacinda deflected by instead answering by quoting another poll (Colmar Brunton) that was more evenly split (note that CB polled people before the CGT announcement last week i.e. before any details were released and anyone understood the implications).
  
  For the whole interview Susie just let her speak without any interruptions.
  
  Oh how nice for NZ’s most out-of-her depth PM, just lovely isn’t it!

    Colmar Brunton have form for providing survey results with the response the client wants.
    
    Last year, Colmar Brunton provided survey results showing Aucklanders favored a fuel tax. However, when the Council asked the same question twice to Aucklanders they got a different answer. This is despite advocates of the fuel tax trying to rig the poll.
    
    Now we get Colmar Brunton coming out with a poll that favours a fuel tax, quelle surprise!

    Did you see “The Project” Jesse Mugagain interviewed Cindy and some stupid woman interviewd Simon Bridges. Cindy was asked what was her highlight for 2018 “Neve” of course and what what your low light “Oh, The Politics” FFFS.
    
    Simon was told his opinions on CGT were looking out for the rich pricks of course and did he think that was fair. Also the woman laughed and said someone earning $50k could never afford a house scoff, scoff, scoff.

  I just watched yesterdays interview with Bridges, was disappointed with the style of questioning/talking over him while he’s trying to answer a question, and ignoring his obvious answer to asking the same question over and over… cant wait to watch todays puff piece with the SLG to compare the similarities (if any) to how bridges was interviewed!

  The intention is to have the legislation in place before next election to take effect after the next election. Labour would have promised it earlier but did not wish to have to campaign on it last election. The report could not be released any later since it would take at least to the end of 2019 to draft and present the Bill much of 2020 for debates, Select Committee hearings etc. This timeframe is pushing it right uphill to say the least let alone all the other chunks legislation Labour wants to push through. The chances of Labour achieving that timeframe seem small.
  Labour presumably could have kept the report ‘under wraps’ and started having the Bill prepared, but word would soon leak out if they tried that.

When asked on Radio NZ this morning whether there are any ISIS brides with NZ citizenship, Ardern couldn’t give a straight answer. Which means there are ISIS brides, quite possibly with children, that will try to come back to NZ now that the caliphate is destroyed.

She did emphasize that NZ law doesn’t allow her to cancel a passport. So this is another major issue about to blow up in her face (appropriate metaphor). Read it here first.

  So there’s nothing to stop a Kiwi that wants to returning here. Nothing to stop them being arrested and brought before a court either.
  To my mind that’s the way it should be otherwise what’s to stop a government refusing reentry into the country to anyone because they don’t like the cut of their jib if they qualify for citizenship elsewhere.
  With regard to ISIS people returning to the UK. I understand a number already have, but the public has latched on to Shamina Begum probably because of the unapologetic TV interview.

      So a Kiwi in her position could not be stripped of her citizenship.

        MCos,you missed one important point. Her mother is Bangladeshi, making her children Bangladeshi. So, because Begum is/was a dual national (without seemingly being aware of it), the UK were able to strip her of her UK citizenship without rendering her stateless. This opinion has been upheld by Lord Carlisle, a leading UK law lord on terrorism and the law.
        
        Carlisle has advised both Labour and Tory govts on terrorism and the law for the past 20 years.

Good news on Red Radio this morning.

NZTA are dragging their feet on SkyPath and are playing a long game. In that they seem to be betting on a change of govt next year and hope they will not have to build SkyPath. Good riddance to an expensive white elephant.

It seems although the govt have agreed in principle to build it on a public asset, the group (a trust) who have campaigned for it want $1mill for the intellectual property for their design. This money is to pay an assortment of consultants including KPMG, an engineering consultancy, a town planning consultancy and Infratils owners who were trying to set it up as a PFI.

Bevan Woodward, if you get any money out of the taxpayer for this scam, pay it to Auckland Transport to repay the money they wasted on your Kowhai Connector Bus service.

  I spent a while as a volunteer on a Kibbutz many moons ago, it was meant to be true communism in action.
  The primary rule was you had to do your work, almost NO exceptions (we used to joke that if you stood on a landmine and your leg was pushed 1/2 way up your arse, the nurse that had to sign you off as unfit for work would find an alternate duty).

    One can have sympathy for people whose lives are adversely affected by the chemicals that build up in their own body to conspire against them.
    Sometimes people try to fight back while it remains a battle.
    Slater just took the lazy path of lashing out at people and using quotes like:-
    “I play politics like Fijians play rugby. My role is smashing your face into the ground.”
    “if you want sympathy look in the dictionary between shit and syphilis”. Not an original.
    
    Slater can look in the dictionary for all I care.
    He is the author of his own misfortune and will continue with malice and deceit as long as he is able.

    Control of the legal proceedings would go to the Official Assignee. If Cam had initiated proceedings, the OA would review them and decide whether to continue them or not depending on the likelihood of success and any money they could bring into the bankrupt estate. OA is unlikely to continue any defamation proceedings initiated by the bankrupt. The OA would endeavour to settle any lawsuit faced by the bankrupt as expediently as possible but has the advantage that the OA on behalf of the bankrupt may not be worth suing.
    Possibly OA may settle with Matthew Bloomfield for $5k or so but Matthew may not see the money nor his costs. The three health professionals may well drop their suits and get on with life, or accept token damages from the OA.
    So bankruptcy may let a person off the hook with respect to such lawsuits but at the cost of reputational damage and stigma that goes with it. The some of the bankrupt’s usual rights and freedoms are also affected eg ability to travel overseas (should the potential bankrupt go overseas before being declared bankrupt, but it may not be practicable in this case) not being able to be a company director, having to advise people of bankruptcy when seeking loans, opening charge accounts etc.

        Interesting point. Things depend on who owns what with Whaleoil including whether the ‘Whaleoll’ brand is protectable and who owns ts IP. If Cam owns (or in some cases recently owned) such property the OA could claim it and put it on the market. He may own it together with SB. He could offer to buy it back from the OA or the OA could put it up for tender or auction. SB and others could re-brand the site, including re-branding the meat packs etc.

        If it is CS personally then bye bye meat packs.
        If it is through a company then it depends if CS is a shareholder or not. If he owns shares then they fall into the control of the Official Assignee. If they have value then subject to the companies constitution the OA can sell them.
        From a casual inspection of the companies register CS has no existing directorships and only minor shareholdings in the companies he is or was associated with.

      The decision against Slater in the Colin Craig trial was a total contradiction of the decision in the Jordan Williams v Colin Craig trial over the same matter, and I think would have been worth fighting.
      
      There were no damages or costs awarded against Slater in that case because the Judge said Craig had no reputation to start with.

Whaleoil blogger Cameron Slater has declared himself bankrupt.

Slater suffered two strokes in October which left him partially paralysed on his right side and unable to concentrate and with speech and vision impairments.

The right-wing blogger issued an update on his health on his blog saying ongoing medical tests showed he remains severely “incapacitated”.

The blog post states that due to his health issues he is unable to work and subsequently had made the “very difficult” decision to declare bankruptcy due to being unable to generate revenue to fund defamation actions against him.

They get criticized for meaning negative about the government’s policies but not offering any of their own. This is true but the only sensible thing for them is to wait till much closer to the election.

Hopefully National will go strong on law and order.

National should not panic in the meantime as long as they stay over 40%.

  Now Shipley has to pay that amount out, albeit for an unrelated matter.

  Basically the first director is liable for $36M but if he cannot cough up that amount the other three directors including Jenny would have to cough up $6M each though liability insurance may help.
  So the second, third and fourth directors will be looking to the first director to cough up. There are a few other things too.

      For the $6M each directors it all probably depends on whether they knew or ought to have known that there was ‘reckless trading’. It could be too that they had failed to undertake properly the normal expected duties of directors including curiosity and asking hard questions.
      I would have thought that after prominent lawyer Bruce Davidson as Chair of Bridgecorp had to pay $.5M and copped home detention for being a party to unlawful dealings, that ‘figurehead’ directors like Jenny Shipley would have considered their situations very carefully and jumped ship if they felt uneasy.
      I do not know the bounds of Directors and Officers Insurance, but surely it was intended to cover Murphy’s Law type issues, not general negligence or inattention to duties by a director. So the $20M cap that apparently exists would amply cover Murphy’s Law issues although insufficient for a serious systemic lapse.
      As far as the first director is concerned, it seems he greatly benefited from the siphoning of money out of Mainzeal which while not apparently criminally wrong was a serious breach of fiduciary duty (ie trust) so he presumably cannot claim on D&O insurance. I doubt the liquidators could directly claim on the insurance in his case since the insurance is for the benefit of directors and officers personally, not the shareholders or creditors.
      Liquidators if lucky may get the $18M from the three directors perhaps with help of insurance.
      Possibly, the four may make a partial offer to the liquidator subject to not making them bankrupt with the implication that if they were bankrupted the liquidator would get far less. The amount offered could well come from trusts or from overseas sources not accessible to the liquidator.

I have wondered how it is that these dangerous Lime Scooters are allowed on the footpaths travelling at speeds at over 25 kph weaving in and out of the pedestrians along the footpaths and startling people as they rush by in very close to a person who is totally unaware of there proximity.
Contrast this to the situation where the law regarding the use of cycles on the footpaths is limited to a vehicle with wheels up to 355mm in diameter and a helmet must be worn. Exception is delivering mail or newspapers.
We now know how they have got onto the footpaths. All the cities I have seen them in are run by Labour. What a surprise.

    I’ve got no problem in principle with electric scooters on city streets.
    The issue is where do they fit in with other street users.
    Some people don’t use them, don’t like them & want banned. I don’t used them,don’t take my car to the Auckland CBD. As far as I’m concerned private cars can be banned and the scooters can use their space. I reckon I wouldn’t be alone on that either.

I’m a Catholic and quite keen for all the dirty laundry to come out in the wash. My attitude is pretty much summed up by this .

However, on this one involving Card. Pell, I am a little perplexed. How can the evidence of one victim, which is completely counter to the reported statement by the other that it never happened, be good enough? I am not saying it never happened, but knowing the sacristy and how difficult it is to be alone for more than 5 seconds in it after Mass, combined with the fact Pell’s reforms were shafted by Pope Francis after Pell was getting too close to the financial skulduggery at the Vatican does make me wonder.

We shall see from any appeal if it arises.

  I went to some Catholic schools including four years boarding and there’s a number of religious in the whanau.
  I wasn’t aware of any sexual deviancy among the priests, but drunkenness was another issue indeed.
  A chap I went to school with was ordained a priest and in recent years was convicted of sexually transgressions.
  
  I saw on the news the other day the gathering in Rome of a whole lot of top brass from the church and it could have been Saudi bloody Arabia. Not a female amongst them. Just the same old nodding heads who didn’t have a clue what to do except issue another firmly worded statement.
  The Catholic Church is an ultra conservative totalitarian organisation whose power is fast dwindling away. It’ll cave in on itself.
  They have incomprehensible regulations designed to keep the faithful in line. Well, the days of mind control are gone and people want answers to questions. Why can’t priests marry? What’s wrong with birth control? Why can’t the big cheese be a female? Why is everyone beholden to Rome?

      I saw kids without any religious background being suckered into cults when they headed out into their own life.
      
      So although my kids didn’t get a great exposure to religion, I was always supportive if they wanted to go to a religious do with one of their friends, or stay at a church-based camp.
      
      Oddly enough some folks assumed we were rather religious as we have a couple of the gdfather-in-law’s icons on our walls, as well as a framed pic of the abbey on Iona…. but they are only there as family memorabilia.

      We already sent too many kids to universities, which should not teach strictly vocational subjects like law or accounting.
      Were I wearied by the realism of old age, I would hold out some hope for the proposal to reform the polytechs.

Particularly in the late 1990s under the Bolger/Shipley governments, the bums-on-seats funding model encouraged universities to venture into polytechs’ teaching areas, as well as vice versa. Another way to “clean up” the universities (and the polytechs) would be to stop making them pretend they’re engaged in some kind of business activity.

        There was no allegation of criminality, fraud or corruption levelled against Shiply and the judge was at pains to point out that she and two other directors acted with honesty and in good faith throughout.         She was chair of the company and as such failed the company by not having proper audit and legal functions that should have been in place to ensure that there were the funds to carry out the business in a legal manner.

Although it is true that I have possibly ‘been there and done that’, I am not an 8 year old gelding even in camel years.
I have never been accused of either having a good let lone excellent temperament or of being friendly lol and I am not about to change that now.

I have not been easy to catch either in pasture or without, and if caught am really good at slipping the halter :).

I was however ‘transported’ for a while.

Rachel (not my spelling) does mean ewe in Hebrew but I am damned if I know why you would call a gelded camel that, but I do have a fondness for donkeys, and I have never named them after myself either. Rachelle is close enough so I will give you latitude because I now believe you are ‘special’, although I can not say that I have ‘noticed’ you before and will not notice you again.

Anyway thanks for the laugh it quite took me to a time and place when my children found it hilarious at the Wellington zoo that I had a close encounter with a dewlap and camel.

Oh and if my ex husbands could have got $10,000 US for me, I am sure that they would have, but as I have never known my place, I am not worth anywhere near that amount.

        A family of seven kids. The UN would naturally give them priority for settlement in a Western country. The UN gives low priority in refugee resettlment for Middle East Christians, for Yazidis, and I haven’t heard of land-robbed Boer farmers being helped to resettle by the UN. Haven’t heard either of resettlement in the West of ethnic Russians or ethnic Ukrainians from the battle zone in Ukraine.
        
        The UN is run by the Third World. I hope Trump stops American cash propping it up.

Really, about history? The bits that I agree with of course, just like everybody else.
I have every bit of mongrel, hero, bastard through the English line that gave us the Magna Carta and back through William the Conqueror,and crown heads of Europe, in my DNA and I will own it, the enlightenment, the pushing back of the dark ages, the rebellion against the all powerful religion, and Royalty (wrong side of the War of the Roses), the people not the autocracy, despite other ancestors being the autocrat.
So in awe of my forbears, seemingly every historical figure of note. They are predominantly why we are where we are now. I like it, if you don’t, I don’t care.

I found university an enlightenment, possibly not quite the enlightenment that was intended, but an enlightenment all the same. I have whakapapa, and it is awesome.

So there is more in the CGT report than just CGT it seems.

The fund has also suggested international investors pay a concessionary tax rate of 14 per cent on profits made in New Zealand on unique signature infrastructure projects (instead of the 28 per cent corporate rate).

The Michael Cullen-led tax working group agrees and has recommended the Government considers the development of a carefully designed regime to encourage investment into large, nationally significant infrastructure projects that both “serve the national interest and require unique international project expertise to succeed”.

This is a purely political choice.

The detail needs scrutiny and what have the Nats done? Rush to the headline or do they agree with these other items?
