Convoluted Trusts.

Huka Lodge, one of New Zealand’s best-known luxury retreats, is at the heart of an acrimonious dispute between 69-year-old Alex van Heeren and 74-year-old Michael Kidd.

The two businessmen have had a marathon 20-year court battle in New Zealand and South Africa over Huka Lodge and a number of other assets.

The courts have found in favour of Kidd and ordered van Heeren to pay US$25 million ($37 million) plus costs.

Andrew Little has now utterly lost the 2017 Election for his party beyond any hope of redemption.

By defending the 28-year-old mother of eight who has finally been turfed out of her last Housing New Zealand house after alleged meth use – and he did, on national television – Andrew has managed to alienate about 90% of the population.

Even really poor people will find the position deeply, deeply offensive. In the same week, Labour advocated raising taxes to address poverty. The proximity of these two headlines is doubly disastrous.

There is nothing that National need to do now except shut up, stay focussed and let Andy carry on.

But perhaps ACT can make the upcoming election a crossroads for New Zealand, by loudly and without shame identifying (details above), and then encouraging the mainstream to progressively slough off the tiny percentage that wreck so much for so many of the genuinely unfortunate. As someone on here pointed out the other day, they are cutting holes in the safety net, and then everyone will fall through

They should not be prevented , but full costs of any damage should be visited upon them. And they should also be told , if you get into grief ,you’re on your own.

Mr Key gave a strong hint yesterday that the Government could go as far as appointing commissioners to run Auckland if the council doesn’t find a way to provide land for more housing.

“Mark my words,” he told reporters after being asked about the possibilities for dealing with an unco-operative council.

The Government, which is under increasing pressure to rein in runaway house prices, will soon introduce a National Policy Statement (NPS) which will require some councils to relax restrictions on where houses can be built.

In a post-Budget speech to a business audience in Auckland, Mr Key provided further detail about the NPS on urban development, which is expected “in a week or two”.

The policy is mainly targeted at Auckland Council.

Mr Key said that if land prices in any region were going up too quickly, the local council would have to free up more land.

“If they don’t do that, they will breach the law,” Mr Key said.

So, now the nice Mr Key wants to bulldoze his options upon others.
Never mind others property rights, never mind policy choices of the elected (not always good), but stamp my feet like a child and bully others.)

Time this lot packed their bags and retired.

The CTU and its CEO Richard Wagstaff about what the budget does for low income workers.Well here is a suggestion Richard why are you still taking union fees off these struggling workers between five and ten dollars a week when some of your worker are asking for food parcels to feed their family’s.I notice we don’t see our unions wavering fees that keep you and staff on large salarys flash cars that might help these family’s in tough times.With all the millions that the union movement s in their bank accounts wouldn’t it be great to see you and you staff give back to the e low income family’s that need help now,like making food parcels help them in this time of need as they have led after the large salary earners and bosses of the unions for years.It is a bit rich condemning the Government for not looking after the low paid worker when all the union does is take money from their members that mostcan not afford

Unless this succeeds Corrections will carry on the same way and more innocent people with die and children will be abused. Just recently a sex offender was housed next to a school and their was no notification. This must change.

It is so appalling that National never understand Local Government and now are showing the dictatorial attitude they are after having the ability to prevent the situation that has developed.

The secret agreement that seems to be in place to have mass immigration , to the tune of 60,000 a year , is the real problem and no wonder the bottom end is being spat out as a direct result.
Along with this National forced an entity on the people in a totally undemocratic way setting up a super council that was doomed to fail given that bigger is not better and socialists take over the ship and with the help of the LGA that allows ratepayers money to be spent on anything then it is a recipe for disaster.

To now threaten the council and democracy again , is beyond the pail.

Cut immigration and change the LGA, not the RMA and it would be a good start.

Why should the long suffering taxpayer have to fork out in this case?
As far as I can see:
1. The sentencing judge correctly sentenced. If he had sentenced the accused to Preventative Detention this would have been overturned on appeal. If Parliament did not like the general approach taken by the judiciary (particularly Appeal and SC judges) the answer lay in remedial legislation.
2. The accused served the full sentence (less a few days). No finger can be appointed at the Parole Board.
3. Corrections properly sought and was granted post sentence supervision of the accused.
4. A significant issue is what is an appropriate scope of such supervision. It surely cannot extend to guards accompanying the accused at all times – this would not have been intended by Parliament. Hence such supervision can never be complete. It needs to be reasonable and within the law including BORA. It cannot be within the law as some people may like to think the law should be (eg BORA should not apply to people like the accused) – if the law is considered inappropriate, this is a matter for Parliament.
5. Was Corrections negligent in the administration of the supervision? Corrections cannot be ‘negligent’ if avoiding the alleged ‘negligence’ required Corrections to step outside the law. No negligence – no damages.

At a glance it seems that the ‘negligence’ present in the Panmure RSA case is not present here.

The people who have donated $150k for legal action would have been better to have given it to the victim’s family.

The 30K speed limit in Christchurch is ridiculously slow, the cop shop is just at the start of it and NONE of the coppers stick to it and I have lost count of how many times they have passed me exceeding the limit. Good to see a couple of council workers pinged seeing as it was their daft idea.
You could just about understand in the very heart of the city but the clowns applied it to two laned through routes where there are few pedestrians.

Attorney-General Chris Finlayson said that the bill’s limits to freedom of expression could not be justified.

Stopping offenders from changing their names was described as “disproportionate” because it was permanent and non-discretionary.

Corrections cannot determine that someone is unsafe to release and therefore extend a person’s incarceration. The law (ie parliament) and the judicial system determine sentencing and management of a criminal. Corrections just carry out the sentence.

Come the end of a sentence, Corrections have no authority to keep someone in jail for whatever reason. They can recommend further monitoring and preventative incarceration, but the judiciary needs to sign on the dotted line.

Blaming corrections is silly. It is like blaming the courier because someone shipped you the wrong product.

Then, of course, in the party will be Fran O’Sullivan, of the Hooerald. She will later, in a few hundred words, givel Hooerald readers, the solution of how NZ can become a world technology leader. Her conclusion won’t include immigration targeted on education and IQ, and it won’t suggest compulsory military service, and it won’t include intelligent State participation (as Israel has via its Army and Air Force).

Just found,after looking for at least 3 weeks,I kid you not,my car which my 21 year old son borrowed to get some beer for a party he was going too 3 weeks ago.

1. Must have been a hell of a party !!!!!

2. Not only was the car missing but mysteriously all traces of petrol were gone.

3. Apparently 3 of his mates and my son found it this morning in my driveway.

4. Son has agreed to watch the car tonight as there is another party and he is willing to watch it like a Hawke.

5. Grateful for my son as he must have hunted for 3 weeks to find find this car ,he didnt have time to eat as he is now starving.

6. Im thinking of voting for the Mana party as they seem to have no trouble swatting kids.

jack 5, interesting that delegation to Israel. However I can’t see how e.g reintroducing compulsory service will turn us into the Israel of the Pacific and the implication that our immigration policies should target those with High IQs . I think that our emphasis on skills and higher education etc takes care of that ( except perhaps Muslims ? ) .

Remembering also that Albert Einstein and Lord Rutherford had parents modest backgrounds who could very well be excluded by your criteria . I could even see someone like Stephen Hawking being excluded also due to his motor neurion disorder that could be treated as making him an imbecile .

You mange to mix some interesting stuff with some weirdness . Keep it up !

– $3b per annum in funding from the USA
– ripping off European/USA made technology via leaks from citizens with dual loyalties.

They were going to use a bulldozer to recover the 4WD’s and that was unacceptable to the roading authority AFAIK.
I just do not see why the police should keep their noses out of it when there is a significant risk of another rescue operation being required both potentially costing the long suffering taxpayer and risking the lives of rescuers.

There is no urgency for the recovery of the vehicles.

Israel has been at the forefront of almost all major medical, agricultural and technological advancements through their own research and development.

Most Arab nations are now coseying up to Israel to get access to cyber security defence technology.

The value the US gets back from the relationship is many times more than what goes in. Almost every American medical and tech company has staff in Israel doing development or monetising their IP

I believe you have said you are not a lawyer. If that is correct do you have a law degree?

The matter is quite simple. You seem to have read the report that I and others have and think the report is correct. We, the taxpayer have paid good money for other poor reports. The Binnie report is a good example. It achieved nothing.

Do you think everyone who has read the report and believes it is a whitewash is stupid or dishonest? I know Ruth Money and I can tell you she is not stupid and neither is Antonio Gotingco.

If the Human Rights Act is interpreted to say the rights of evil psychopaths trump the human rights of good decent people this needs to be tested in Court. If the Courts find that the rights of sub human psychopaths are paramount then we look for a political solution.

This whitewash of a report says the DoC was right in not notifying the neighbours about the ticking time bomb in their midst. We not have a peadophile living albeit temporarily next to a school and the school is not notified.

There are other issues as well like letting him have a car that must be challenged. If Correcting are not liable to pay the Gotingco’s a cent even if it can be proven they were negligent why did they not issue an apology?

The DoC can notify the public if their is an evil dangerous person in their midst. If they do not they are negligent. If the crim does not like it he or she can take the matter to court at their own expense not the taxpayer’s.

We have people objecting to the taxpayer paying Antonio Gotingco but do not mind money going on an expensive repetitive report and legal aid money going to criminals because their feeling are hunt or there has been some breach of privacy. Paedophiles do not deserve and privacy.

peterwn is far from being the only legal expert commenting here who reckons that suing Corrections is a waste of time & money. It is one of those cases where weak sentencing for earlier crimes allows a psychopath to continue wrecking lives.

As such, the true target should be parliament as it is their responsibility to provide an adequate sentencing structure & not tie judges by crap law that restricts them. eg the Sentencing Act 2002.

Like them or leave them, the SST is the only ginger group that consistently pushes for justice as opposed to law. If the people who have donated to Mr Gotingco’s appeal got in behind battlers such as McVicar & David Garrett instead then something might happen.

I believe David Garrett does not agree with the DoC and the white wash of a report. He can correct me if I am wrong.

I am driving 125 km to the Rotorua rally and am happy to take passengers.

…I believe David Garrett does not agree with the DoC and the white wash of a report. He can correct me if I am wrong.

He has, and he has said any civil action against DoC for the death of Blessie Gotingco is likely futile. So all those giving to the appeal are doing little more than enriching lawyers, feeding their own sense of anger while kidding themselves they are doing good…and maybe prolonging Mr Gotingco’s grief. IMHO. Although there may be some therapeutic value for him as long as he doesn’t get emotionally trapped in the process.

I just hope he manages to move on, unlike poor Michael Choy’s mother who gets thrust into the public eye every time Bailey Kurariki hits the news again. I know why she does it, especially the perceived need to “do something” so her son’s death has some value and meaning, but I doubt it is for her good.

It’s not a matter of not supporting Ruth Money but I think she is fragmenting the support which would be better directed to the SST..I can understand why she left as IMO McVicar made a bad decision when he stood for the Conservatives as the SST is better off not aligned with any particular party.

This National government, particularly the Minister of Justice could do a lot more to protect vulnerable children and teenagers. However, there are more votes in demonizing men. She is seriously considering giving women a license to kill.

The school’s appeal to the Teachers Council shows it fought for Back to be allowed to continue teaching and for his contact with the deceased girl to be legally suppressed.

The plea is made in a letter obtained by the Weekend Herald from board of trustees chairman Theo Ackroyd, who is also a police officer with a responsibility for investigation into crimes against children.

Mr Ackroyd said the board of trustees had found Back was guilty of “serious misconduct” and reported him to the Teachers Council.

However, he said, there was no barrier to Back returning to the school.

As per nasska, your real issue is that these people are paroled with the intent of reintegration, not DoC who have one hell of a job, within their budgets, to manage the risk when violent and/or sexually dangerous offenders are released. They have certainly not done a perfect job in the past, as per the Panmure RSA murders, but the best you can hope is that their systems improve with experience.

You ask what can be done? Elect politicians who will pass strong laws against violent and sexual crimes, put sufficient money into policing, justice, corrections and prisons (so don’t complain if your taxes go up to fund it!), and appoint judges who will sentence accordingly, and public officials who are diligent and zealous to implement government policy.

But good on you for at least trying to do something to sway public opinion to vote accordingly…

nasska, There is more to it than I think you know. I say Ruth is doing a very good job as a victim advocate. She has her own reasons for working on her own and she should not be criticized for that.

Having said that I do not agree with everything she says. Sometime she like anyone who is happy to front up with their real name has to answer questions on the spot.

I think you are correct about 24/7 individual monitoring. I would put more emphasis on the car and lack of notification of the neighbours and a couple of other issues. However, the money collected is to get some legal advise. It could be from more than one lawyer. There is a lot of public support for putting victims’ rights ahead of villains’. The Minister of Corrections may decide a apology and an ex gratia may be appropriate.

Hmm. Given your posting history, I’ll ignore just this once your almost-certainly deliberate mis-spelling of my name, and give you the benefit of a doubt you are not trolling, and extend you the courtesy of an answer:

In many cases, yes, Corrections are rightly obliged to protect the anonymity of serious offenders, as it would jeopardise their chances of successful reintegration back into the community.

Which leads back to the real objection, that we take the risk of releasing potentially dangerous people like Tony Roberston back into the community. You want stop another tragedy as befell Blessie Gotingco happening? Then lock ’em up and throw away the key, and forget the distraction of the Department of Corrections doing their best to try and control/monitor and manage the risk of chaos.

Here is a tourist who made a momentary mistake quite likely because he was not used to driving on the left. He paid reparation and accepted responsibility for the deaths. The DoC claims they were totally blameless and did not have the decency to apologize. The independent police complaints authority found the police lacking in the death of a young man with mental health issues. The police apologized. What is it with the DoC and bloody judges that they cannot apologize when that make a bad decision that costs an innocent person their lives. It would be easier to get an apology from Donald Trump.

You are just exemplifying New Zealand’s obsession with having someone to blame when things go wrong. If you want someone to blame, blame Tony Robertson. You say the bad decisions cost her life. They didn’t. What cost her her life was a decision by an evil man to murder her. It is clear that, short of manacling Robertson to the wall, he couldn’t be stopped. The law did not allow it. The law is made by Parliament. If it’s not good enough, get it changed, but don’t blame the poor bastards who administer it to the best of their ability

Judges all the time expect people to be wise in hindsight be it driving or hunting.

There are two issues here. First was the DoC negligent. They were not making a split second like a hunter or drive but a supposedly well considered decision with a bunch of so called experts when no one had the final say and responsibility. The second issues is if it can be demonstrated ideally to a jury that the DoC was negligent should they be accountable. This is just another Cave Creek or Pike River.

If the bloody judges did not collectively insist on being treated like demigods and could be held accountable they might make better decisions. Legislation is a factor but that does not exoneration the DoC or judges that are more interested in points of law than common sense.

If by doing-so you are going to obtain votes, then apparently it is, the larger number of votes being sought, the less accountability.

The NZLP are specialists in such matters, seeing absolutely nothing wrong with the practice (except when they are caught, but even then penance is fleeting and only because their actions have been brought to public gaze).

I was walking past some of the Auckland ‘Homeless’ outside the Supermarket today- Trying to ignore them as they swore at and abused me because I wouldn’t give them cash..
What’s a bet if we give these smelly ferals $5000 to ‘relocate’ they will be back in Auckland within a month?
