The problem with the anti-Trump folks on the Right is that they are in a house that is burning down and they want to throw a glass of water on the fire. Whether it’s the massive Islamic invasion of Europe over the last twenty years, with all the crime and terrorism that brings, or the Mexican invasion of the US, or the growing legal war against Christians in the West in the name of special rights for sexual fetishists, or any number of other examples, the house that is the West is burning, and half measures or weak cuckservative candidates like Rubio are of no use. Again, it’s like trying to put out a raging fire with a glass of water.

I have been down that path of moderation and trying to find some common ground with the liberal order. It’s a dead end. The old liberal-democratic order that sustained the West after WW2 is gone. In Britain and several other European countries you can now be prosecuted as a criminal for even mild criticisms of Islam or Islamic immigration. In the US the Obama regime is considering making criticism of AGW a crime.

Wake up folks. While conservatives were working to protect the liberal-democratic order the Left captured it’s major institutions and big business and is using those to wage a war against the West, it’s cultural foundations, and it’s peoples.

Recognizing that we are in a war, a fight to the death, in many respects literally, is the first step in realizing that moderation and politeness are useless. Extreme situations and crises need extreme measures and extreme people willing to fight for them and not give an inch to the enemy. That is why support for Trump in the US, the National Front in France, Alternative for Germany, or many other parties and people is growing, and why weak, compromising leaders on the Right are losing. People are waking up to the fact that their homes and lands, their basic freedoms and cultural/religious traditions, their very civilization is under serious threat of extinction.

The anti-Trump Right wants to dither and play nice while Rome burns to ashes. Good luck with that.

I had a read. That sort of thing is unavoidable, in today’s climate. You just have to help your own kids get through it, and also help them understand why such anti-bullying measures have such traction in schools. Including explaining how difficult it is for kids who are different, in any way.

I just finished reading a piece from Jonah Goldberg in which he agonises, even as he tries to make light of various friends and collegues who are either supporting Trump or going the anti-anti-Trump route, like Bill Bennett:

Here’s an abbreviated list of [Bennett’s] books:
The Book of Virtues
The Devaluing of America: Fight for Our Culture and Our Faith
The Death of Outrage: Bill Clinton and the Assault on American Ideals
The Broken Hearth: Reversing the Collapse of the American Family

And here’s just a few things that I would have thought the author of these books would find disqualifying for a president of the United States and de facto standard-bearer of conservatism.
– Trump said it doesn’t matter what the media writes about you “as long as you’ve got a young and beautiful piece of ass.”
– Trump boasted that his ordeal of avoiding the clap while sleeping around so much amounted to his own “personal Vietnam.”
– He said that John McCain’s ordeal avoiding dying at the hands of his torturers wasn’t heroic.
– As for everyone else’s Vietnam, Trump got out of that by claiming to have a medical condition that instantly healed when hostilities ended.
– He bragged -in print! – about bedding married women and has admitted to cheating on at least two of his wives.
– He boasted that he “whines until I win.”
– He’s condemned Charles Krauthammer, George Will, and many other friends of Bill’s (including yours truly) with far, far more vitriol than he condemns Vladimir Putin, the butchers of Tiananmen, and David Duke.
– The man is so lacking in moral clarity that he dismissed Vladimir Putin’s murdering of journalists by saying, “I think our country does plenty of killing also.”
– This is a man who expresses a passionate desire to change the First Amendment so he can punish journalists who don’t kowtow to him.
– This is a man who praised the mass murder at Tiananmen and criticized Gorbachev for not being as tough-minded.
– This is a man who says he “reads the Bible more than anybody” but can’t – after months of opportunities – speak intelligently about it for 30 seconds.
– This is a man who, by any objective measure, lies nearly as much as Bill Clinton but with a tenth of the skill.
– He lacks the patriotic seriousness to do minimal homework, even when his ignorance has been pointed out time and again. (Bill’s colleague Hugh Hewitt asked Trump about the nuclear triad in August. Several months later, when the question came up again Trump was, if anything, more ignorant.)
– This is a man whose business dealings have been shot through with shady practices, mob ties, and fraudulent claims (also known as “lies”).
– This is a man with a totally thumbless grasp of what the Constitution is about or what conservatism is (“Conservatism means,” according to Trump, “to conserve our money”).
– This is a man who boasted for months that he will torture our enemies and indiscriminately murder their children as a matter of policy. – This is a man who says that the last Republican president deliberately lied us into war and plays coy about whether 9/11 was an inside job.

Now, Bill has criticized some of these things, he just doesn’t think they add up to anything that justifies trying to keep this guy from taking over the GOP or the country. And, bear in mind, I haven’t even talked about Trump’s “policies.”

People who think that Trump is going to fight for them are going to be sorely disappointed. For all the whining about recent events in Chicago, I recall that in the wake of the Jihadist gun attack on Pam Geller’s Draw Muhommed cartoon debate, it was Trump who chastised her for being provocative.

This last weekend, after thousands of complaints by members of the public over the years, police finally decided to act and went on an Auckland wide man hunt, seeking one John Phillip Key. This one time merchant banker is wanted for questioning over derivatives trading, currency trading, personal investments, and his involvement in the Irish economic crash. He has been also reported for masquerading as a Prime Minister for almost a decade. Police were coy on what charges they might lay, but said they are extensive. He has damaged the New Zealand economy almost beyond repair and is wanted for hurting a good many ordinary folk, including our most vulnerable in our society. He needs to be taken off the streets before he causes anymore harm.

I know I’m being glib and jocular as I criticize Bill and other friends. That’s basically how I argue. But let me be clear (as Obama likes to say too often): I hate this. I hate it. I hate attacking people I respect. I hate hearing from former fans who say they’re ashamed to have ever admired me or my writing. I hate being unable to meet fellow conservatives half-way.

One of the things I love about conservatism is that we argue about our principles; as I’ve written 8 billion times – more or less – we debate our dogma. I love our principled disagreements. But I honestly and sincerely don’t see this as a mere principled disagreement. I see this as an argument about whether or not we should set fire to some principles in a foolish desire to get on the right side of some “movement.”

I have never been more depressed about the state of American politics or the health of the conservative movement. I hate the idea that political disagreements will poison friendships – in no small part because as a conservative I think friendship should be immune to politics. I certainly hate having to tell my wife that my political views may negatively affect our income.

But I truly fear that this is an existential crisis for the conservative movement I’ve known my whole life. And all I can do is say what I believe. If Donald Trump is elected president, I sincerely and passionately hope I will be proven wrong about all of this.

But I just as sincerely and passionately believe I won’t be.

Lucia, we will just have to agree to disagree. But I would make the comment that if Ted Cruz was pulling in the numbers, both in crowds and votes, that Donald Trump is pulling in then he would be subjected to attacks by the leftist thugs as well.

I’m quite happy to agree to disagree. No problems.

I think the difference between Trump and Cruz, were the situation one that Cruz was dealing with rather than Trump, would be (I hope) that Cruz would not be looking to help defend a guy who attacked a protester and said he’d kill him if he saw him again.

Now you might like and prefer gentle moderate people like a Mitt Romney for example to become president of the United States. But I tell you this, they won’t change a damned thing. At the end of the day if you are Conservative or Christian in the public square and in the political arena you have to be prepared to stand up for yourself and in politics right now you have to be prepared to fight.

Just be sure you are fighting the right battle.

The problem with the pro-Trump folks is that they think Trump will put out the fire with the correct amount of water and then some, but all he will do is burn down the entire city to solve the problem of the one burning house. And invite Putin over to watch so they can be best of pals and make deals to serve them both.

The Trump way of solving problems is to make everyone think he has the solution (kind of like one of those psychological tests where the splodge looks like anything you want it to be), and therefore the solution ends up being in the mind of the imaginer. The reality will be far different. Trump is like hope and change for easily led right wingers.

This mentality is opening the door to worse things.

We will never be able to create Utopia on earth. Utopia is only possible in Heaven. This place is a place of testing – that’s it. Our goal is to make our little part of the world better – not perfect – and to be ok with that. And we start and end with ourselves, the log out of the eye, making ourselves a better person and being an example for others. All the rest in relation to that is not important.

I like you Shawn. Don’t go off the deep end on me.

Why was no one prosecuted for contributing to the financial crisis? New documents reveal why

Bethany McLean is a contributing editor at Vanity Fair and bestselling author. Her recent book is “Shaky Ground: The Strange Saga of the U.S. Mortgage Giants,” published by Columbia Global Reports.

“This gags me.” So said Elizabeth Warren in response to a Quora user, who asked, “What do you think are the real reasons that no Wall Street executives have been prosecuted for fraud as a result of the 2008 financial crisis?” Her answer, which she expounds on more thoroughly in her report Rigged Justice, is, “Weak enforcement begins at the top.”

I’ve always thought the lack of prosecution was way more complicated than a simple lack of will, in part because there is a difference between criminally prosecutable behavior and that which is morally reprehensible. But I’m not sure whether we’ll ever know the real answer. Newly public documents from the Financial Crisis Inquiry Commission show that the FCIC referred a handful of matters to the Justice Department for possible prosecution. Most of the time, nothing happened. In the cases where something did happen, our modern system of justice—the special one that applies to big business, that is—means that those of us on the outside—citizens, on whose behalf justice is supposed to be served—will never know the underlying truth.

Don’t we at least deserve to understand?

A little background: The FCIC was set up to investigate the causes of the financial crisis. The commission didn’t have either the authority or the resources to do a criminal investigation. But as the documents show, a number of matters—involving Goldman Sachs, AIG, Merrill Lynch, Citigroup and Fannie Mae—were referred to the Attorney General. No criminal prosecutions arose from any of those. (In Citigroup’s case, the SEC settled with the company and two executives in the fall of 2010 for a paltry sum. The Commission drily noted, “The SEC’s civil settlement ignores the executives running the company and Board members responsible for overseeing it. Indeed, by naming only the CFO and the head of investor relations, the SEC appears to pin blame on those who speak a company’s line, rather than those responsible for writing it.”)

Why? Well, really, we have no idea.

The FCIC also referred what I’ve always thought was the area in which Wall street had the most exposure to the criminal authorities. That’s what Wall Street firms told investors they were buying when they bought mortgage backed securities. Or as the FCIC labeled it, “Potential Fraud: False and Misleading Representations about Loan Underwriting Standards by UBS and Other Issuers.” (UBS is mentioned specifically only because the FCIC first discovered what was happening by looking at UBS.)

Back in 2010, FCIC investigators found that a firm called Clayton Holdings, which was hired by Wall Street firms to investigate the mortgages that were being packaged into securities, was finding that they were not what they were supposed to be. Clayton examined almost a million mortgages, according to the FCIC’s analysis, and found that almost 30% failed to meet the underwriting standards that had been set, like the amount of money the borrower had put down, and didn’t have other factors that might compensate for that. And yet, Wall Street waived almost 40% of those questionable loans, sticking them into securities anyway. (Clayton kept track of the waivers in order to protect themselves from potential liability.) The banks didn’t tell investors. “In some cases we felt that we were potted plants,” Keith Johnson, president of Clayton Holdings, told Reuters at one point.

It seems that in the run up to the crisis, the big banks were doing their best to play ostrich. In its public report, the FCIC wrote, “Only a small portion—as little as 2% to 3%—of the loans in any deal were sampled. When those loans turned up turnips, the banks didn’t do the logical thing, and have Clayton go investigate a bigger sample. Instead, they hid their heads in the sand—and didn’t bother to inform their investors of any of this. “Prospectuses for the ultimate investors in the mortgage-backed securities did not contain this information, or information on how few loans were reviewed, raising the question of whether the disclosures were materially misleading, in violation of the securities laws,” the FCIC wrote in its report.

The newly disclosed documents go into even more detail about why this might have violated the law. In a document entitled “Material Misstatements and Omissions in Various RMBS Offering Documents,” the FCIC laid out a potential case. Securities laws require sellers to “adequately describe for potential investors what they are offering, including the risks which may be associated with making such an investment. If the seller makes a false or misleading statement of (or omits to state) a material fact in a prospectus, it can result in the issuer of the securities and underwriters being liable to investors and becoming subject to federal prosecution. The prospectuses and other offering materials used in connection the sale of residential mortgage backed securities in a substantial number of offerings between 2006 and 2007 (and maybe before), may have contained false statements and omissions relating to disclosures about the credit risks and origination standards of the underlying mortgage loans.”

The FCIC went on to note that while the banks did disclose that they might include loans that didn’t meet the stated criteria, they didn’t disclose just how many loans that was. And if a loan didn’t meet the stated criteria, there were supposed to be “compensating factors.” If there weren’t compensating factors—or if the banks hadn’t even bothered to look to know if there were compensating factors—well, then this was a false statement. And if the statement was material, “there could be a violation of the federal securities laws.” Or as the FCIC put it, there were “two possible areas of misrepresentation…failure to disclose the gross numbers [of] waivers of underwriting standards, and inaccuracy in disclosing that not all waived loans had confirmed compensating factors.”

People have been sent to jail for less. See Enron.

What happened then? Well, in this case, not nothing. The big banks have paid a lot of shareholders’ money to make this go away. The Wall Street Journal just did a remarkable tally, and found out that the big banks have, to date, paid $110 billion in mortgage-related fines, many stemming from the Justice Department’s investigations. (The Journal’s examination of where the money has gone is a scandal in and of itself, but that’s another story.)

Take a closer look at Morgan Stanley, which settled with the Justice Department on February 11, agreeing to pay $2.6 billion. (This is one of the smaller settlements, but it’s also the most recent one.) According to the statement of facts that accompanied the settlement, Morgan Stanley “did not disclose to securitization investors that employees of Morgan Stanley received information that, in certain instances, loans that did not comply with underwriting guidelines and lacked adequate compensating factors and/or had understated loan to value ratios were included in the RMBS sold and marketed to investors.” In other words, Morgan Stanley knew bad things, and it did not inform investors who were buying the securities it created of those bad things. The statement of facts also illustrates how Morgan Stanley overrode Clayton. For instance, Clayton flagged a cash out refinance loan made to a checker at a florist shop, who said she had an income of $9000 a month. Morgan Stanley overrode the decision.

In announcing the settlement—which the State of New York signed onto as well—Benjamin Mizer, the head of the Justice Department Civil Division, said, “Those who contributed to the financial crisis of 2008 cannot evade responsibility for their misconduct.”

Oh, but yes, they can! There is not a single name in the entire statement of facts. Bad deeds were done, but no human being did them, and that responsibility that could not be evaded was born by the banks’ shareholders, not by anyone actually employed by the bank. (A caveat: The document says that it does not release either the firm or any individual employees from criminal charges. But to date, those have been totally empty words.)

I’m not arguing that individuals or the banks for sure should have been prosecuted. Morgan Stanley, along with all the other banks, clearly was able to marshal some evidence that no matter how horrendous their behavior was from an ethical standpoint, no one broke any laws. Or as Justice noted in the statement of facts, “The United States believes that there is an evidentiary basis to compromise potential legal claims by the United States against Morgan Stanley for violations of federal laws in connection with the packaging, marketing, sale, structuring, arrangement and issuance of these RMBS.” What this means is that the Justice Department wasn’t sure that a case against Morgan Stanley was winnable.

So the two sides hammered out a settlement, every single word of which you can bet was heavily negotiated. The Justice Department gets money, and gets to trumpet a victory, and Morgan Stanley and its employees get to walk away. More broadly, that’s what has happened with all the banks. And the rest of us? Well, we don’t know whether the big banks bought off the US government, or whether the US government extorted the banks. We’re left with no real answers as to why no one could be prosecuted in a crisis that defined our times. Now THAT makes me gag.

GOLDMAN SACHS: The market is underestimating the Fed in one critical way

The Federal Reserve has expressed concern about tight financial conditions and how it puts pressure on economic growth.

Indeed, when the popular measures of financial conditions tighten sharply, it’s common for market pundits to conclude that the odds of a near-term rate hike from the Fed are falling.

However, Goldman Sachs economists warn that the “markets may be underestimating Fed officials’ tolerance for tighter financial conditions over time.”
What the Fed said about tight financial conditions

Among other things, tight financial conditions are reflected in surging interest rates, widening credit spreads, tighter lending standards, and falling stock prices (^GSPC).

Financial conditions tightened substantially after the Fed hiked rates on December 16. And the Fed addressed it at its January Federal Open Market Committee (FOMC) meeting.

“While acknowledging the possible adverse effects of the tightening of financial conditions that had occurred, most policymakers thought that the extent to which tighter conditions would persist and what that might imply for the outlook were unclear, and they therefore judged that it was premature to alter appreciably their assessment of the medium-term economic outlook,” revealed the Fed in the minutes of its January meeting.

There was no rate hike at that January meeting, and financial conditions have since eased.

Aside from the title there were some other good paragraphs

I feel a bit like Malcolm McDowell in A Clockwork Orange. No one has strapped me to a chair or attached those metal scaffolds to my eyes to keep them open as I watch that oleaginous clump of non sequiturs sweat his insecurities on national television. But I still feel drained as I try to resist what feels like a kind of crowd-sourced brainwashing spread across the land like a wet rolling fog.

At times, I sometimes think I’m living in a weird remake of The Invasion of the Body Snatchers. If you’ve seen any of the umpteen versions, you know the pattern. Someone you know or love goes to sleep one night and appears the next day to be the exact same person you always knew.

Except.

Except they’re different, somehow. They talk funny. They don’t care about the same things they used to. It’s almost like they became Canadian overnight — seemingly normal, but off in some way. Even once-friendly dogs start barking at them. I live in constant fear that I will run into Kevin Williamson, Charlie Cooke, or Rich Lowry and they will start telling me that Donald Trump is a serious person because he’s tapping into this or he’s willing to say that. I imagine my dog suddenly barking at them uncontrollably. (I don’t worry about this with Ramesh because Vulcans are immune.)

Yes, I liked those paragraphs too. The guy does a good job describing the surreal nature of what is going on. I’ve always wondered how collective insanity would play out, and now here it is happening, and beyond unisex toilets and what not.

Somewhere I read that 5% of the population pull the other 95% along, with 2.5% pulling from either end. It does take something extreme to see how it all plays out.

We are no different to those who were pulled along by various ideologies of the past century, even though we like to think we would be immune.

Before I go to cook, I have to say I’m sorry I didn’t answer you on Thursday. We were talking about the Pope and the wall, etc.

I was sitting in the blood test queue, looking at my phone. I logged in and then decided not to try and formulate a reply as my name would be called once I did so. I probably could have, as I waited for 45 minutes, but you never know it’s going to be 45 minutes until it is. And after blood tests, I have no motivation to reply to anything. Weird, really, but that’s what they do to me.

And now I find I just don’t want to get back into it. 🙂 Anyway, this is just a wave hello with a long winded explanation.

Another example is that at present I seem to have lost (again) the ability to edit comments for 3 minutes. This feature switched back on for a couple of days last week – but now it’s Kaput. Java updates needed? Flash? Who knows.

That’s annoying. Editing works fine for me.

I’m really bad at keeping my software up to date, in that I’ve turned off automatic updating, and I force the damn thing to ask me before installing anything. Except for Firefox, that seems to have a mind of it’s own. And I can’t be bothered investigating where to turn off the automatic updates for it.

So, maybe you are too up to date, but not up to date enough, and subject to current bugs?

Can I say to Lucia and Tom Hunter that I like Jonah Goldberg but he and the rest of his people at National Review have contracted a bad case of TDS otherwise known as Trump Derangement Syndrome.

Jonah is losing his mind over Trump, he is a great danger to the nation and he is not a conservative and blah blah blah.

But look if Trump is not a conservative he is probably going to be fairly middle of the road as Potus. Sort of like Bill Clinton but without the interns.

In reality he is a New York businessman who will concentrate on enriching the wealth of Americans and doing something about illegal immigrants and will hopefully bomb the hell out of ISIS.

Actually the most ideological, most rigid, most right wing candidate is Ted Cruz.

So Trump is likely to focus on a few key issues and otherwise be reasonably moderate IMHO.

Maharey said it was simply time to “move on and do other things”.

Given his long history of supporting Democrats and “liberal” causes I’ve no doubt he could be “moderate”. However, if one did want to see actual conservative judges on the Supreme Court and a host of other right-wing ideas implemented, then Trump would not be the choice.

In fact, the key thing about him is that nobody has any idea what he would actually do – probably because he doesn’t know either. But there is one aspect of the man that shines through is described here:

Incidentally, though this won’t matter because facts just don’t matter, Trump is himself a PC Goon. He piled on Pamela Geller when she staged her draw Mohammad event. Hours after an Islamist shot at her conference (and wounded a cop, IIRC), Trump fired his own shots:

Trump is not committed to freedom. What he values most highly is order. That’s because he’s an authoritarian.

And when someone like Pam Gellar speaks up and says something politically incorrect which causes a break in order, his reaction is to attack the person “making trouble” — here, the speaker, not the shooter.

After all, if Pam Gellar had just remained orderly and kept her drawing between the lines of acceptability, none of this disorder would have occurred.

The fact that Trump is a weird, power-loving authoritarian should not be controversial. He’s said as much, heaping praise on the Chinese government for being “strong,” dismissing Gorbachev — who’s “Openness” initiative freed the Russian people for a time (but it turned out they longed to be ruled, and gave that freedom up) — as not having a firm enough hand.

What were your other impressions of the Soviet Union?
I was very unimpressed. Their system is a disaster. What you will see there soon is a revolution; the signs are all there with the demonstrations and picketing. Russia is out of control and the leadership knows it. That’s my problem with Gorbachev. Not a firm enough hand.

I don’t see why being worried about this counts as TDS. I saw BDS in full throttle and it’s not the same thing, especially since it’s coming from the side that Trump supposedly joined. As “Ace” explains:

Trump found fault with Gorbachev for his “weakness” – without any acknowledgement of the fact that Gorbachev’s “weakness” was an act of great courage and rightness. When people rise up to protest a hopelessly corrupt and failed system, you should let them have their say.

But that doesn’t enter into Trump’s calculations. The only important thing is having power and keeping power. Therefore, Gorbachev’s a fag.

Similarly, he heaps praise on the Chinese (and now claims one of the few words he’s running on, “strong,” is not a compliment). The Chinese did the right thing by brutally putting down those protesters — doesn’t matter that those protesters were in the right.

What matters is that a government which had the power of force used that force to break someone’s will.

That’s all that matters. Strength, force, power, coercion.

I guess George III would have proven himself a worthy tyrant had he just fought the Revolutionary War more viciously and stamped the American revolt down. Gotta have a firm hand.

And he finishes on the same point I’ve made about what this could mean for his worshippers (now there’s TDS, it reminds me exactly of the Obama retards in 2008):

This is why the Michelle Fields incident is important. Not because, as someone so eloquently said, because “some bitch dropped a curling iron on her arm.” But because it’s a power-worshipping, force-loving group of thugs getting off on their power and ability to get away with inflicting force on their opponents.

I know a lot of people view this as a good way to inflict vengeance on Democrats. The problem is… Michelle Fields and Breitbart were not Democrats. They’re allies.

They were just in the way, and asking an impertinent question.

They got the exact same treatment that some are hoping Trump gives “the bad guys.”

Trouble is, he seems to think anyone objecting to him is “a bad guy.” Today it’s Michelle Fields.

Who knows – tomorrow, when he goes back to his old position on assault weapons and decides you are now a nutter making trouble like Pamela Gellar, it could be you.

It took away the authenticity of the whole programme, but it just illustrates how compulsory Maori input is when NZ On Air funding is involved.

Why did the British settlers come to live in NZ ? Was it . . . to become Maori ? It should be take it or leave it – not bend over all day and take it up the backside. I want to hear a traditional story about moas. How does that one go ? Or – how their spiritual beings told them that slavery was really cool ?

There were an estimated 100-200K locals dotted around NZ pre-1840. Didn’t quite own it enough to keep outsiders out. So – ownership is a tricky concept. For a while – Hitler owned a lot of Europe. He tried obtaining Russia. Russia was able to put up a fight – at great cost to both sides. But fight they could. They are not German controlled now. So – Russia owned Russia. The Maori didn’t really therefore own New Zealand. That’s life mate. And where did they come from originally ? Somewhere else. Where did Europeans come from before Europe ? Somewhere else.
