Nick Smith’s ten RMA changes

1. Add management of natural hazards

the management of significant natural hazards has got to be added. New Zealand is one of the most natural hazard prone countries in the world with significant risks from earthquakes, floods, landslides and volcanoes. I give one simple example to emphasise the point – the Bexley subdivision in Christchurch. Hundreds of pages of reports and submissions were written on the effects of this housing development covering birdlife, landscape, coastal impacts, effects of recreation, effects of Maori cultural values, but nowhere did any official consider the effects of land liquefying in an earthquake like what occurred in 2010 and 2011. This was despite this risk having clearly been identified by council natural hazard experts.

2. Recognise urban planning

We need to make is to properly recognise the urban environment. Eighty per cent of resource consents are about urban issues yet currently they rate no direct mention in the purposes and principles of the Act. It is as though the Act was designed for a Garden of Eden prior to the development of cities. The careful design of our urban environments so we have places to live, work, shop and play and the appropriate transport links to travel between them is core to the proper functioning of the Resource Management Act.

3. Prioritise housing affordability

recognising the importance of more affordable housing. The Productivity Commission’s 2012 report noted a sharp shift in the type of housing being built since the RMA was enacted. They noted that 30 years ago, New Zealand built a healthy mix of new homes across the price spectrum whereas today new homes are pitched towards the top of the market. Thirty-five per cent of new homes built were sold below the then median house price as compared to just five per cent today.

4. Acknowledge importance of infrastructure

Good infrastructure is essential to the functioning of a modern nation – whether it be for transport, communication, water or energy. The stories of 19th century London, Auckland or Nelson without a reticulated sewer system emphasises the connection between the environment and infrastructure. Even today, many of our urban water pollution problems relate to poorly designed or maintained sewerage and storm water systems. The absence of any mention of the importance of good infrastructure is an anomaly in the RMA that needs addressing.

5. Greater weight to property rights

Give more explicit recognition to property rights. There always has to be a balance between the rights of a person to use their own land and the wider community interests, but the pendulum has swung too far. We are looking at amendments that limit the degree to which council officials can meddle in people’s lives. We also want greater discretion for councils to waive the need for resource consents where the wider environmental effects are negligible. So in examples like I cited with the Stoke Medical Centre, the Nelson Young Parents School or Bob Jones’ window, the council could waive the requirement for a consent.

6. National planning templates

Consolidate this mountain of RMA rules across our councils. It does not make sense for a small country of four and a half million people to have each of the councils reinventing the wheel. For example, we have over 50 different definitions of how to measure the height of a building. We intend to legislate to require councils to use standard planning templates. Councils will still be able to choose from these templates what will apply in different areas but rather than having hundreds of different rules across the country in residential areas there will be a standardised range.

7. Speed up plan-making

Speeding up the plan-making process. The process set out in in Schedule One of the Act is cumbersome, inflexible and slow. It takes on average six years to complete a plan. We have had residential housing go from boom to bust and back to boom in this timeframe. The OECD has made plain that responsive and timely plan making is essential to avoiding the sort of property bubble that wreaked havoc in the recent Global Financial Crisis.

8. Encouraging collaborative resolution

Fostering a new collaborative way of resolving resource management issues. The RMA processes currently favour a litigious and adversarial approach. We have been experimenting with collaborative processes where those with a range of interests are encouraged to get around the table and find a balanced solution.

9. Strengthening national tools

strengthening the powers for national regulation. The RMA makes provision for National Policy Statements and National Environment Standards but these have been used infrequently. Our Government has done more in five years than previous governments in the preceding 18 years covering coastal management, freshwater management, metering of water takes, contaminated land and renewable electricity. However, these tools remain cumbersome. Take a simple issue like requiring all dairy farmers to fence their stock out of rivers. It is a policy most New Zealanders would agree with and indeed farmers and Fonterra have developed a Clean Streams Accord to that effect.

10. Internet for simplicity and speed

Reframe the Act into an era of electronic communications. The current Act still requires truckloads of paper to be shipped between submitters. For example, all submitters on a plan change must get a copy of other submitters’ views. There are sometimes 10,000 submitters to a plan and the council can be required to provide a paper copy to each of the other 9999 submissions.

The public notification requirements are equally arcane. Councils need to be required to have their full up-to-date resource management plans publicly available on the Net and in a form that is readily accessible and understandable to the general public. The age has also arrived that councils rather than being required to send out full applications and submissions in paper form need simply to make the information available on the Net.

A study by academics at the Cardiff school of journalism examined the BBC Today programme’s reporting of the bank bailouts in 2008(12). It discovered that the contributers it chose were “almost completely dominated by stockbrokers, investment bankers, hedge fund managers and other City voices. Civil society voices or commentators who questioned the benefits of having such a large finance sector were almost completely absent from coverage.” The financiers who had caused the crisis were asked to interpret it.
The same goes for discussions about the deficit and the perceived need for austerity. The debate has been dominated by political and economic elites, while alternative voices – arguing that the crisis has been exaggerated, or that instead of cuts, the government should respond with Keynesian spending programmes or taxes on financial transactions, wealth or land – have scarcely been heard. Those priorities have changed your life: the BBC helped to shape the political consensus under which so many are now suffering.
The BBC’s business reporting breaks its editorial guidelines every day, by failing to provide alternative viewpoints. Every weekday morning, the Today programme grovels to business leaders for 10 minutes. It might occasionally challenge them on the value or viability of their companies, but hardly ever on their ethics. Corporate critics are shut out of its business coverage – and almost all the rest. On BBC News at Six, the Cardiff researchers found, business representatives outnumbered trade union representatives by 19 to one(13). “The BBC tends to reproduce a Conservative, Eurosceptic, pro-business version of the world”. This, remember, is where people turn when they don’t trust the corporate press.

From what I see of public sector workers, they are all a bunch of tick box morons who spend all day typing inane comments on blogs.

How about they adopt the following pay formula for all public sector workers:

Let them try find a job in the private sector with their “skills” and see if if they get a written offer of employment. If they do, then the Government should match that and use the cushy public sector hours and job security as the “kicker” in order to keep them in the public sector.

I suspect the number of public sector workers who would get a pay rise will be somewhere in the region of nil.

5. Greater weight to property rights

The Ashby high-rise case was a setback for the development industry, but not a fatal blow. The developers have already broken ground and will appeal the damages upheld by the judge. And the tower will be far more out-of-scale than most — 21 stories in a single-family neighborhood, nearly as wide as it is tall — and located in a very wealthy neighborhood. While some fear that the judgment will embolden other homeowners to sue for damages, it’s worth noting that every attempt up until now has failed, and the vast majority of other dense developments have gone up around the city without a fight. Even if the Ashby case sets a precedent, it would only affect the rare, very large project in very wealthy, pristine single-family neighborhoods, and it won’t impose much of a tax — at 1717 Bissonnet, the judgement only works out to a few thousand dollars per unit.

The judge suggested in his decision that the city adopt a zoning code, but a lot of money has been staked on land without density restrictions, and Mayor Annise Parker’s spokeswoman told the Wall Street Journal that the mayor thinks it’s “way too late for zoning in Houston.” While there may be bumps in the road, over the long term, Houston has become considerably more friendly to dense infill development, and will likely continue the trend.

Gareth Morgan has an article in this mornings Horrid. As usual he is telling us all how we should live. This time it’s all about the treaty of Waitangi. He reckons pakeha (a word I hate) nearly exterminated maori. He now suggests te reo should be compulsory in all primary schools and thinks there should be an upper house of parliament of which half the members would be Maori and the treaty should be enshrined in law. This quota and treaty garbage sounds like future Labour policy. Mind you what else would you expect from a bloke who thinks North Korea is the utopia we all dream of.

Gareth Morgan and another one of his “white men bad” rants, mixed with pining for an assumed lost socialist egalitarian paradise of the noble Maori Savage ruined by the money hungry white man.

Bad things have happened in history Gareth. Bad things have been done all over the world, by all peoples. The Aztecs, Mayans and some Incas for example, practised human sacrifice and exterminated jungle tribes in the process. Until white man bought Maori the gift of civilisation, Maori were habitual cannibals, practiced infanticide and they actually DID EXTERMINATE the Moriori.

And can the likes of Morgan not see his hypocrisy? They are all pro-multiculturalism when it comes to Islam immigrating into Christian lands and thus diminishing their culture, but if it was the other way round, TWO HUNDRED YEARS AGO AND EIGHT GENERATIONS AGO, then it is a crime for which we must all be damned for, for all eternity.

One hopes the proposed RMA changes won’t be pared back by that coiffured fossil from Ohariu. The mention about Bob Jones’s window may be a glimmer of hope that councils will be able to override Iwi objections, but I won’t hold my breath on that one. Environmental lawyers hopefully will have to look for other work if these changes are effective.

Whats wrong with this weak bloody National govt I and many more voted for?

They have a majority of 1 with the support of ACT.
Get on and implement ALL the changes required to the RMA ASAP.
Tell all the other parties including the maori one to get stuffed.
These are the changes required and they will be done by xmas. Not next year, or the following year, but this year.

This pathetic Act should be repealed in full, along with Palmer’s Local Government Amendments, where we now have councils being run by fiscally dyslexic socialists. When we had successful members of society elected to councils, we had financial prudence, infrastructure maintenance, realistic rates, and representatives being paid a sensible honorarium. With the introduction of Palmer’s failure we now have a line-up of overpaid useless troughers, very few with any abilities other than a degree in sociology, and agendas that make even Russel Norman appear a capitalist. Look at the line-up of failed ex-Labour MPs at GWRC, one even having form.

We have a right leaning majority in parliament who’re going to sort the RMA , I won’t hold my breath.

A final thing on Gareth Morgan drivel – why is it when I read stories such as this I am always left asking the same question:

Did Maori gain no benefit whatsoever from European Settlement?

They got protection from the marauding French, they got a written language, advanced healthcare, wheels, common law, education and the universal language, and end to their barbaric practices, advanced farming methods, an extended life expectancy. And let’s not forget – New Zealand was not a nation when the Maori were here – just a collection of warring tribes living a primitive existence.

This constant attack and diminshment of European culture worldwide by the far left and forced mass 3rd world immigration into white countries eventually leads you down an uncomfortable path and questioning what is the ultimate agenda – to end European civilisation once and for all:

I don’t trust Smith and his attempts to change the RMA ,especially Sections 6 & 7.

I would approve a big change to section 8 by removing reference to the ‘principles’ of the TOW of which there are none but he wont do that as Flavell would have hikois from hell.

Funny how people like Morgan who I enjoyed when he talked about economic matters years ago, morph into experts on everything.Somehow he has been brainwashed by Maori indoctrination and does not appear to possess the ability to weigh up a wealth of information that gives us historical truth about NZ 1840.

Well if labels are being tossed around about movies, then surely criticizing too many movies ‘about white male geniuses’ is a huge sin.
After all Alan Turing was homosexual, so these lefties are homophobic….. bastards!

Also Alan Turing was an interesting character… unlike some other shit movies out there.
Anyone who invents the computer and helps win WW2 can’t be all bad 🙂
Movies about tanks and snipers are pretty good as well.

On Smiths point one.How come when I built pre CHCH earthquake, I had to get an engineering report that indicated possibility of liquefaction and had to deal with.?
I had a feeling this was covered under the Building Act.

Is “Forgotten Baby syndrome ” in respect of the death of the toddler at Wanganui Hospital PC gone mad and the Doctor / Mother responsible guilty of culpable homicide ?

Or does the death remind ius if the overwhelming tragedy of the situation ? Instead of pointing the finger we are reminded of a moment when we have had ourselves had a near miss with our own child/ children ?

A moment of inattention or forgetfulness where we can count ourselves fortunate that something tragically disaterous could easily of happened .

Thinking about Smiths suggested changes further it looks like tinkering with section 6 and 7 in his way will be in conflict with the purpose of the Act ,section 5 .

His changes are not going to affect housing affordability one iota.
How about putting a halt on mass immigration?

Usual hand wringing crap from guilty wealthy whities.

If we are going to single out a group for an aspirational goal for betterment (although I thought that was racism?) then Maori need to be better educated academically and/ or entrepreneurialy. And if said goal was attained what would happen… Maori would be much wealthier, crime would plummet, health would improve, housing would improve and it would a much easier ‘sell’ to non-Maori that their language was worth learning.

That would be a better discussion than lots of new compulsory Maori centered laws and increased handouts.

As a direct descendant of the French in New Zealand I must protest. If my forebears had their way the South Island would be French. The South Island would be a separate country with excellent Bordeaux style wine, wonderful fresh food ingredients married with classic French cuisine and endless lines of hot slim French women ready to greet you with a smile and a Bonjour!

Things could have been a lot worse 🙂

Motives/ reasons? Again is there an implication that I’m a puppet of some foul master?

My motives for blogging here on KB seem pretty transparent. I’m not a fan of misinformation/ BS. I try to add a few facts when they are pertinent to debates I follow.

bureaucrats? All those who work in health, from cleaners up, deserve increases, but many bureaucrats slithering up Lambton Quay each
morning sure as hell do not. In fact, government should be looking at disestablishing many PSA- Clark-created positions these jerks are filling. Time there was a public register of all job descriptions, salaries, qualifications, and tenure, identifying those employed in this taxpayer-funded joke. It must be hard for service-related public servants, being used as a lever by unions, to gain salary increases for bureaucratic drones, who outside their protective shell, would be unemployable. The PSA are doing health/service public servants a disservice.

Enemy at the Gates was a good sniper movie with lots of tension, even if (like lots of historical war movies) it took heaps of dramatic licence. Nearly anything with Ed Harris is worth watching.

Good submarine movies like The Hunt for Red October are a great format as well, but bad ones force you to suffer through 2 hours of actors in a tin can!

Wiseown – I am sure Nick will overhaul S5 (purpose). Since ‘the meaning of an enactment must be ascertained from its text and in the light of its purpose.’ (S5 Interpretation Act 1999 – my favourite clause of all legislation) it goes without saying that S5 RMA needs to be tuned up to express what he is hoping to achieve with his proposed amendments. A court can also divine ‘purpose’ from ministerial statements, select committee reports, Hansard records of debates, etc, but a well written ‘purpose’ section can avoid much trouble later.

I would think that would be highly unlikely, not to mention confusing and conflicting for the Courts given the original legislation is 25 years old. How can a subsequent Government expand on the “purpose” of a 25 year old statute and still make it possible for the Courts to interpret?

Especially when your intended meaning of the new “purpose” (such as speeding up construction) presumably conflicts with the main original purpose which is the sustainable management of resources and the environment in the eyes of greens and bureaucrats.

Scrap it and start again.

This is not how the REAL world works for the rest of us. If anyone else helped themselves to major amounts of money for lavish birthday parties, cars, etc you would find yourself in your local prison for embezzlement, or theft as a servant. This is complete corruption. It’s like putting a bunch of kids in charge of running a bank.

A local hotelier in Taupo is now telling stories of extravagance and no accountability by this bunch of idiots.

Folks need to keep clear about this. JK, Cameron and others have publicly recognised this. That recognition should be supported, as should accepting the opportunity IS have offered to fight out in the open in Syria and else where, stopping their fighters from returning to Europe as a priority, along with those having travelled there to enhance being radicalised.

For those provoked by the thoughts of the Very Reverend (or Irreverent) Garth Morgan, don’t forget to recall the actions of the NZEF and the Second Maori Battalion and their predecessors 20 odd years before in the ME, some of whom remain buried there. From that emerged the ‘Camel Company (in WW1) and the Long Range Desert Patrol in WW2 from which grew the SAS, as they are today, keeping alive NZ’s opportunity of being a democracy and fierce, when provoked, defender of the rights of its citizens.

In NZ we have at least two political parties who agitate for greater rights and privileges for the Native (or first arrivals) people. These parties are consulted endlessly and are the darlings of the left.

In the UK and Europe there are political parties who are doing exactly the same thing for the indigenous peoples, these parties are constantly attacked by the left. These parties cannot speak out as anything they say is classed as hate speech.

Things were a bit better when there was a full public service list available which listed the names, qualifications and grades of all public servants. These days, any salary details are considered ‘personal information’, although I don’t ever recall anyone complaining about it in the good old days. I would go further, and publish the tax records of all New Zealanders as well.

These days, any salary details are considered ‘personal information’, although I don’t ever recall anyone complaining about it in the good old days. I would go further, and publish the tax records of all New Zealanders as well.

But the information would be much more easily accessed today.

Sure back in the day the information may have been theoretically available, but if you had to physically walk into an office in Wellington and hunt through masses of paper records to find it then very few people would have bothered. If this information was available today somebody would write an app WhatAreTheyWorth? that could instantly pull up anybody’s record on a whim.

the correct response to that kind of wrong thinking is not more wrong thinking. You have accepted the notion of race based laws promulgated by the left. You just want to favour a different race.

The Maori population was about 100,000; they had achieved a limited carrying capacity. Europeans interbred with Maori. Dr Maynard of the Asia was picked up in the Port Levy chiefs jolly boat which was rowed by “15 perfectly naked women”.
European nations are developed and mass migration has come at a cost to per capita GDP.
Maori are most opposed to mass migration from Asia (I don’t mean a faux Maori elite).
Care to comment on that?

(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;

(d) Imposing measures intended to prevent births within the group;

(e) Forcibly transferring children of the group to another group.

I’d say western politicians are engaged in c and d.They ae intent on “destroying’ the west as we know it, through mass immigration, abortion and multiculturalism.

Windows 10 keynote just finished. Looks great.

Its going to be a free upgrade for anyone with Windows 7 or 8.1.. They have addressed all the hate that windows 8 got.

Windows 10 will work across PC’s/tablets/phones & Xbox. Impressive.

I suspect I will be rocking a windows phone in another year or two.

Where have I ever mentioned race based laws.

Read my 8.43am post yesterday if you want to see who the problem is – it’s Marxist Politicians who are playing us off against each other and using the organs of the State and MSM to cultivate division. Most people like to live in peace and cooperate with each other (also called civilization) but Alinskyites like Morgan want to tear all that trust and cooperation down and have us fighting each other.

From my post yesterday:
“Whilst people are fighting each other they do not take notice that the traitors in their governments are stealing their freedoms, taxing and inflating them into poverty and running their countries into the ground.

And what is this bullshit about me disparaging you as a racist and genocidist. Racist – well yes actually – that does seem to fit. But genocidist – were you even awake when you read what I wrote. Genocide involves killing people. That is the whole point. And while I think you are a pretty revolting human being in many respects I don’t think you have ever killed anyone, let alone attempted to kill off an entire race.

I would have no problem with that information being widely available. I think we treat too much information as personal on rather dubious grounds.
