STUFF, February 11. reports [a load of bollocks]:
“Andy Earl, 41, of Mosgiel, has pleaded not guilty to charges of careless driving causing death and careless driving causing Allan Hubbard’s death 16 months ago, injury to Mr Hubbard’s wife, Jean. Mr Hubbard died as a result of a crash on State Highway One at Hilderthorpe, about 8 kilometres north of Oamaru, on September 2, 2011.
“On Friday, the Oamaru District Court registrar confirmed [Mr] Earl is to appear in court on Wednesday in order to determine when a hearing will be held.
“We have been liaising with police and defence to set a date. It will probably be in June or July, when the judge is free for four days.” The hearing had been set down for December but police requested an adjournment.
“At the time Oamaru Police detective sergeant Dan Keno said prosecution and police needed more time to complete inquiries. A prosecution review had identified “a couple of matters” that needed looking into.
“[Mr.] Earl was charged in February last year. “

What a load of bollocks.
If Police had evidence to charge Mr Earl (is he the former All Black?) in February 2012, then they should NOT NEED MORE TIME 12 months later “to complete inquiries.”
He has a BOR’s right to a speedy trial. Yeah right. 🙂 Throw out the case and charge Police with malfeasance. 🙂
This is simply a cased of Police over-reach and classic abuse of State powers. In the meantime, Mr Earl’s life is on hold. By the bye, I do not know and have never met Mr Earl. And, I object to the pejorative absence of “Mr.” when Mr. Earl is mentioned by Stuff. Typical Police-Media spin.

Um, how? If the Police didnt go through a process properly, we should rightly be pissed at them. I cant comment on a year being good bad, normal or not, but it wasnt a normal situation – and yes, suicide was on the table.

As for excluding “Mr”, thats common practice, no Police Media spin at all. But by all means keep pedaling the conspiracy theory angle with sod all evidence, its kinda fun 🙂

The real reason the Australians won’t give New Zealanders welfare rights is because they don’t like the way New Zealand is used as a back door to Australia by Asian and Indian (and three English guys I know to be fair) “New Zealanders” who can’t get into Australia on that countries immigration criteria, but can get into NZ on ours. So they come to this country with the sole intention of living here until they can become citizens then they gap it to Aussie. The solution would be to open up Australian welfare rights to all New Zealanders WHO WERE BORN IN NEW ZEALAND and reside in Australia…

Whale Oil blogs about how representative democracy is flawed, and how we are run by ‘The beige dictatorship.

There’s a simple reason for all of this – we keep leaving it to politicians to give us better democracy. They are mainly interested in giving themselves more power and they use and abuse democracy accordingly. The electoral rules get decided by politicians, Parties find ways of taking advantage of them, for funding, for self promotion, for election – and they have now even hijacked Citizen Initated Referenda process (that was useless for citizens anyway).

Don’t expect the MMP review and the constitutional review to make much difference.

And I think there is a simple remedy. People who want more democracy and better democratic processes need to do it themselves, not through the politicians but despite the politicians.

I have ideas for how this can be done, a two level approach. The first level is a democratically run people’s lobby group, the second level is a means of guaging public opinion on important issues.

The best way to make democracy work is to make it work, don’t expect politicians to do it on their own.

Reading the review of Seven Sharp in today’s Dom Post I experienced a sense of Deja vu. I then realised that The lefty TV reviewer seems to be using ideas taken from Kiwiblog commentators.

For example, stating Close Up was like War and Peace compared to Seven Sharp; Use of the term “What Now for adults” etc.

The western world has been through this. Read Sir Peter Hall’s “Cities of Tomorrow: An Intellectual History of Urban Planning”.

The education of most urban planners today is unfortunately lacking
in basic understanding of urban land markets and the relationship
between demand, incomes, supply, and mobility. It is a pity that what
was common knowledge at one time, has been lost, because we actually do
need it. In Victorian times, the understanding resulted in a strong urge
to increase mobility and increase the “supply” of land to bring urban
land rents down. The rate of “sprawl” in radial “ribbons” adjacent to
rail lines over several decades, was greater than that associated later
with automobile based development, BUT it was far less effective at
bringing urban land rents down, because the process could easily be
captured by the land rentier class.

Automobile based development meant that the far greater volumes of
land in the wedge shaped gaps between the rail lines, stretching out far
beyond the fringe as well, was suddenly part of “supply” and of course urban
land rents fell because of that. Furthermore, much of that land was more
efficiently located relative to the existing built-up area, than the
supply of land extending out yet further beyond the existing rail-based

You make the statement with no backing whatsoever – yes, a year is a year – but compared to what? Is it a long time in cmparison to others? I dont know. Do you? How is it abuse? How have the Police over reached?

I suspect given how quick you were to resort to childish name calling you dont like debating facts, but would rather shout meaningless unsubstantiated drivel. But feel free to prove me wrong.

I am not sure how to answer the poll on the main page about the party I would least like to see in parliament

Is it the party furthermost away from my values? That would be Mana
Or the party which has the most realistic chance of failing to make the threshold this time thereby meaning another National led government? NZ First
Or should I just engage in extreme wishful thinking that we would probably never have another left wing government again? Labour
Or the party, that is comes second in all those criteria and first on average? Greens

Another example of poor ‘reporting’ courtesy of the Hoorald last Friday and, true to form there has been no follow up piece explaining the real issues.

On Friday the Hoorald headline screamed that Kiwi travellers were being ripped off because Wellington Airport was charging ‘too much’ for landing charges and the airlines had no option but to pass on these charges to the travelling public. On the surface, this rationale seems reasonable – until the facts are unearthed via a rudimentary search of Annual Reports / Media articles / Court Decisions etc.

Wellington Airport (as a regulated monopoly provider) has a rate of return (broadly) determined by Treasury – and the ROR for Wellington Airport is currently set at 8.1%. So, if the Airport was valued at, for example $100M, then the ROR (using 8.1%) would be $8.1M. But if the same asset was valued at $500M, the ROR would be $40.5M and so on. So the key factor here is the value of the asset.

A basic search shows that the airlines have been complaining about landing charges at Wellington since the 1980’s – and they even appealed the valuation methodology via the Courts (but lost). But now the Commerce Commission has questioned the valuation methodology and suggested that the travelling public is paying too much – because they disagree with the valuation methodology used at Wellington Airport. Which suggests the Commerce Commission has now become the property valuation gurus in NZ and they know better than the Courts. Go figure.

Now, I support Air NZ – and I travel a lot. But this latest claim that Wellington Airport is ripping off the travelling public is absurd and I suspect cynically timed to coincide with the current reviews of landing charges in progress between the airlines and both Auckland and Christchurch Airports.

But does the Hoorald delve into this? Nah.
And do they seek the facts to support the claim of travellers being ripped off? Nah.
All the Hoorald has done is recite the media releases from the Commerce Commission and seek the opinions of someone from Air NZ!

We really deserve better from our media…. but I doubt we’ll get it any time soon. And yet the same Hoorald will currently be sitting around tables wondering and worrying why their readership numbers have hit another nadir….

I am not sure how to answer the poll on the main page about the party I would least like to see in parliament…

I’m happy to see all parties in parliament, if enough people vote for them and they meet the required criteria.

A more important question is which party or parties that it would be undesirable to have in Government. Even then there are many variables. I wouldn’t mind Greens in coalition as long as they didn’t have too much influence and they didn’t have control too much say in Finance.

I’d be happy to see Mana in Government as long as Harawira didn’t effectively hold the balance of power.

Mighty River Power’s share value is driven mainly by the prospect of future profits. Any real threat to profits or share value will make Mighty River a risky investment, even before the share value actually drops. Investors won’t want to buy if there’s a risk the share value will fall instead of rise, as happened with Facebook shares recently.

If the Government doesn’t get a high enough sale price, then there will be huge pressure for them to NOT sell Mighty River Power and it will raise serious questions about the ability of the Government to privatise or sell other publicly owned assets.

1) All investments are a risk
2) Most investors expect a return on their investment
3) Companies are in business to make a profit.

Keep up the good work Penny, your campaign will lower the share value which will make Mighty River a cheaper target for a takeover by a large offshore conglomerate therefore creating a situation where Mighty River will be a cheap buy with huge earning potential.
P.S. Hopefully I can raise enough capital to jump on the cheap shares before anyone else and make a few million easy peasy.Thanks Penny.

You might not want to know the NAMES of the consultants/contractors, the SCOPE, TERM or VALUE of the 5000 contracts to 12,500 suppliers to Auckland Council and CCOs (Corporate Controlled Organisations) – but I do.

CIV-2011-404-8284 – for the Local Government Official Information and Meetings Act reply, dated 21 November 2011, from the Manager of Auckland Council’s ‘Democracy Services’, Darryl Griffin, where he states, in reply to my question:

” 1) Is the Auckland Council, in a truly ‘open, transparent and democratically-accountable’ way, going to ensure that citizens and ratepayers of the Auckland region are going to be given the ‘devilish detail’ so we can see exactly where our rates monies are being spent on private sector consultants and contractors?

a) Are the names of the consultants/contractors; the scope, term and value of these contracts going to be published in the Auckland Council Annual Report so that they are available for public scrutiny?

b) If not – why not?

(ANSWER)

“Not at this stage. There are 5,000 contracts related to 12,500 suppliers. To collate and publish these would be a major exercise logistically and cost-wise…..”

The commonsense thing to – is google their name and see what comes up?

Obviously you are too intimately involved in all your anti-corruption activities to appreciate this, but a person who refuses to pay their debts solely for political reasons does not have a credibility leg to stand on.

Most of us who comment on here have to work to earn a crust, and like good citizens, we try to pay our bills when they become due, rather than point-blank refusing to pay because we have some beef with the organisation who sends the bill. That’s what good citizens do.

Work is really good for you. It gets you out and about, and socialising with people outside your normal circle of friends; you should try it some time. I’m sure that your organisational skills would serve you well, although if I may counsel you, I’d suggest that you leave the dopey conspiracy theory stuff off your CV; employers tend to find that somewhat off-putting. I’d also write to YouTube, and ask them to remove all content about you, especially that video showing you screaming like a banshee when the police arrested you when they evicted the Occupy Auckland protesters; this one – http://www.youtube.com/watch?v=vSqdialKkWw

Oh; and as an aside, someone was yelling out as you were dragged away “The whole world’s watching”. I hate to rain on your parade, but the whole world WASN’T watching that charade, which for New Zealand’s international reputation is probably a good thing 😀

And on the partial sale of state owned energy companies and AirNZ there was a mandate, it’s called a general election. National announced the policy at the start of 2011 when JK announced the election date and campaigned on it that year.
Despite political opposition and election campaigns from the left, national still won the 2011 election easily. You and your ilk are rather DIM Penny and have ZERO credibility.

Prime Minister John Key says he received an intelligence report just before Christmas that a boat from Indonesia with hundreds of asylum seekers was planning to head to New Zealand.

How do you pronounce the word ‘nude’? Nude with a ‘nu’ as in noodle? Or nude with a ‘nu’ as in ‘news’?

I use the latter pronunciation myself. Came from south of UK at age eight is probably why.

I heard Andrew Saville on One News tonight saying nude with the nu in noodle way. I don’t like it and I hear it more and more on TV and radio.

Has it always been that way or is this a newer trend? Americanisation?

FBI Employees Download Pirated Movies and TV-Shows

BitTorrent is used by millions of people every day, even in places where you wouldn’t really expect. New data reveals that employees at the FBI’s Criminal Justice Information Services Division are sharing movies and TV-shows with the rest of the world. Is the FBI gathering information on BitTorrent users, or could it be that the feds harbor in-house pirates?

The big question is of course why these FBI IP-addresses are showing up in BitTorrent swarms.
The most likely explanation is that employees were downloading these videos for personal entertainment. This wouldn’t be much of a surprise really, as we’ve seen this before at congressional offices the Department of Justice, national parliaments, record labels and movie studios.
Another option is that the FBI is downloading the torrents as part of an ongoing investigation. However, this is less likely as ScanEye shows that the downloads are spread out over several months.
Or perhaps the IP-addresses were spoofed by Kim Dotcom to get back at the feds

I see Penny no longer uses the term “judicially recognised” as often in her comments.
What does “judicially recognised” mean? Is that when the magistrate sees Penny and says “Not you again!”

johnboy- yeah it’s funny eh mate? I hate the pretty people because it’s a fairly stupid reason to be given a job ahead of someone else- and yet I love looking at them. hahahahahaha. I don’t even want to see ugly men. I’d rather look at Simon Dallow than Mark Sainbury if those were the choices.

I reckon they should record One News ten times with ten different sets of presenters and then you can choose who you want to look at. You want two smokin hot sexily dressed lovely young chicks reading off the same autocue? You got it buder….

Well…. that’s the Americanisation of the McWorld over the last sixty or so years with TV, film and music and the internet.

NZders now sound like Americans. More so in the words that they use. The NZ accent persists… will that be next?

How long will it take for all NZders to speak with an American accent?

I hear all the time words I try to steer clear of… closet, closure (for grief), elevator instead of lift. And sidewalk? Ye gods…. that’s becoming standard English in NZ. Sidewalk.

I don’t know why but I’m interested in all of those differences and the shifting culture of language use in NZ.

Last week we had seven metres of global warming …. in white!

Most ski resorts pray for heavy snow each winter but the people of Cauterets in the French Pyrénées may have overdone it this year. The resort had to close this week after 7 metres of snow fell in recent weeks. Sixty workers at the resort, stationed 1,800 metres high in the mountains, have been working around the clock to try and clear away the snow so the resort can reopen on Friday.

Then over the weekend global warming hit NY. According to Dr David Viner, a senior research scientist at the climatic research unit (CRU) of the University of East Anglia, within a few years winter snowfall will become “a very rare and exciting event”. “Children just aren’t going to know what snow is,” he said.

Hundreds of stuck vehicles in Suffolk County, Long Island, NY. This is RT 25 through the area near a Walmart. Many have been stranded since yesterday evening! Some were rescued by snowmobile. Near 30 inches of snow fell with drifts 5 feet or higher!

Of course the ALARMIST nutjobs blamed the blizzard in the US on global warming. The MET data showed that average global temperature in 2011 was the same average as in 1997 at 0.36 C, unlike in the previous decade when temperatures was steady at around 0.44 C degrees above average.”

Johnboy… I’m going to have to look up Bill Toft… streuth… but the latter two I know. I’m of an age whereby I remember Angela D’Audney when she was older… I think they had Philip Sherry reading the news when TV3 started? I know he was from way back when on TV1. And just quietly that’s Philip with one ‘l’, like myself,…. which is maybe why I noticed…
