So a guy in Masterton spent the weekend in the police cells because he was forgotten about. He is entitled to damages (unlawful custody is a ‘strict liability’ matter), the only matter being of how much? My gut feeling is $10,000. He is due to be sentenced for a drink-drive and his lawyer will try and leverage this incident to mitigate the penalty.
There are some issues here:
1. His lawyer and an opposition spokesperson are claiming that cost cutting is the cause of the problem. However there is only likely to be a couple of JP’s, a court clerk and one or two police officers in the court on a Saturday morning in any case so cost cutting does not seem to be an issue.
2. He was nicked on Friday evening for allegedly breaching a bail condition – no background information on this yet. The issue here was whether the breach potentially endangered the public that he needed to be taken into custody. That he was to be bailed after Saturday’s court hearing indicated that the breach did not need immediate police attention. The police could have better used their time catching burglars and asked the probation officer to follow him up on Monday. If the police did consider that he needed to be nicked on Friday night, they should just given him a rark-up, bailed him again and told him to report to the court 10am Monday.
3. This raises the issue of why the District Courts even need to be ‘open’ on Saturday mornings to deal with Friday night arrests. They are not open Sunday mornings. And once an offender appears there is little a JP can do than accept police advice on whether the prisoner should be bailed or held until Monday. Even a District Court Judge is unlikely to make anything more than an interim decision. The Law has traditionally required that anyone arrested by the police has to be held in custody and brought before the court at the first available opportunity – this historically being an important constitutional safeguard. However in more recent times the police can grant bail or otherwise release someone from custody (eg an intoxicated person who has sobered up) on their own initiative. There are also various safeguards against inappropriate custody that did not exist in the old days. There are safeguards within the Police as well as the ability of the Independent Police Conduct Authority. There there is really no need for the Court to sit on Saturday mornings to deal with those arrested on Friday Nights. If the accused’s lawyer considers that holding the accused until Monday morning is outrageous in the circumstances, then the lawyer can request an urgent hearing (the District and High Courts have a 24/7 contact person available for lawyers and there are ‘duty’ judges available). So the Government should legislate if need be to abolish Saturday court hearings.
4. I suspect this is a case where the police used ‘process’ to teach the accused a lesson, but the accused received a stronger lesson than intended. The use of court process as a form of ‘punishment’ is totally unacceptable and the justice system needs to recognise this and there needs to be disincentives to use the courts in this way (eg full costs awarded against the accusers).

  If so the Court staff should have checked to see if they were empty.
  Having said that I agree with Peters suggestion that there may have been some attitude behind what happened.

    AFAIK court cells are managed by Corrections (if on site) or the Police. Court staff may not even have the keys except possibly spares in the court safe. Anyway I doubt that any more than one court employee was on site at lockup. I agree there should be a process to ensure the cells are empty when the courthouse is closed. The custodial officer should leave them unlocked at the end of the day so the court staff member doing the courthouse locking up can check them.

      The cop who was ‘doing’ the paperwork for the victims release didn’t bother to give the victim the completed papers?
      Pay the victim for the improper and illegal imprisonment he suffered…
      Dont bother with taking it to the ‘Independant’ Police complaint whatever. You’ll never hear anything except excuses about how the Police are exonerated and its most probably the victims fault anyway

  To imply that he was left in the cells for 48 hours ‘to teach the accused a lesson’ is interesting.
  
  I would suspect that someone may well be in line for an interview without coffee for this, and if it’s found to be deliberate, they would have to been willing to accept the potential of severe sanctions to their career.

    The intention may have been to lock him up overnight to ‘teach him a lesson’, but the locking up beyond then was unintentional (but totally unacceptable). Nevertheless there seemed (on available information) no reason or justification to lock him up overnight – the option was available to the Police but it would be hard to prove a malicious intent. In the circumstances his sentencing should be delayed for three months and then he should be discharged without conviction as long he has not driven for those three months (though this may not be possible under the Sentencing Act).

      If you were going to lock somebody up overnight to teach them a lesson, I would hope that you’d remember in the morning!
      
      Perhaps somebody with knowledge would be able to explain the process of being in the cells. My understanding is that in the UK, there is a legal duty to check ‘guests’ at regular intervals.

  He is entitled to damages but that is far too much. The amount is to compensate him, so should leave him no better or worse off than if the incident had not happened, i.e. if he was offered a sum of money to spend a weekend in a cell without food, it should be the minimum amount he would accept. No more than $500.

    Damages awarded in the Baigent’s case was $20,000, the Police went to the wrong place and despite being told and realising it was the wrong place did a search anyway. The Crown fought this but the Court considered that the Police conduct had to be denounced.
    There was negligence in the Masterton case and in any case unlawful detention of a person is a ‘strict liability’ matter – that is the custodian is liable for damages even if there was no negligence on part of the custodian (eg a prison manager who calculates an actual prison term using accepted methods is liable for damages for unlawful detention if a court rules the method was incorrect – of course Crown Law would act for the manager and the Crown would pay the damages). The conduct in the Masterton case needs to be denounced therefore something significantly more than token damages is warranted and $10k seems about right or is even on the light side.

    Over coffee this morning I looked at this rag and guess what Bryan Gould pontificating again – as an abject failure both as a politician and a very poor answer at a second rate university he should keep his mouth shut and go enjoy his Gold Card..
    This rag also has some ? woman called Rachael something – what a nasty bitter person.
    Now Rosy McLeod is on the shit stir again.
    Do these people realise the rubbish they are putting in and the rag can find nothing better to spend money on.
    I have suggested to my Coffee Bar owner she hides it when we regularly come in. But she says there are enough idiots who think it is gospel, and she gets it at a very cheap special rate for the bar.
    My wife – the wise one – says do not look at it as it only takes my blood pressure up.
    We cancelled delivery years ago for the same reason.

2016 was the hottest year on record, setting a new high for the third year in a row, with scientists firmly putting the blame on human activities that drive climate change.

The final data for 2016 was released on Wednesday by the three key agencies – the UK Met Office and Nasa and Noaa in the US – and showed 16 of the 17 hottest years on record have been this century.

Direct temperature measurements stretch back to 1880, but scientific research indicates the world was last this warm about 115,000 years ago and that the planet has not experienced such high levels of carbon dioxide in the atmosphere for 4m years.
In 2016, global warming delivered scorching temperatures around the world. The resulting extreme weather means the impacts of climate change on people are coming sooner and with more ferocity than expected, according to scientists.

  If the world was this warm 115,000 years ago, what caused the warmth then?
  Why do you attribute the warmth now to human activity, when it clearly wouldn’t have been the cause 115,000 years ago?
  And how did the ancient hominids survive in what you surmise would have been hostile conditions 4 million years ago, when the level of CO2 was as high as it is now.
  
  Obviously, climate is currently changing, as it has always done, but it seems to me that you want to join dots that shouldn’t necessarily be joined.

  I just looked at the official GISS figures again.
  Go to https://data.giss.nasa.gov/gistemp/graphs/# and where the blue link just above the graph says ‘Global Annual Mean Surface Air Temperature Change’, click it and change it to “Monthly Mean Global Surface Temperature”.
  
  When I looked last month, the newest anomaly reading shown in red on the graph (the ‘Land-Ocean Temperature Index’) was at 0.95C. Now it has dropped even further to 0.81C. You can read the number by mousing over.
  
  So the temperature is definitely coming down.

    ps, Look at the graph – it has monthly averages going back to 1995. The temperature right at the moment, according to the red ‘Land-Ocean Temperature Index’ is 0.54C hotter than it was in 1995. So, just over half a degree warmer in 21 years (and yes, with some fluctuation because of El Nino etc). My response is – so? Seems pretty acceptable to me. And is there any proof that it is human-caused?

The lawyer spoke to ZB last evening but skirted around the question of why no one reported his 48 hour absence. The lawyer was obviously angling for a share of the ‘award’, latching onto the ‘unlawful custody’ aspect. There is more to this than we know.

  I briefly wondered this too. However the only person who would have known he was there was the police officer who turned the key. All things equal his family would have reported him ‘missing’ and the police would have put 2 and 2 together. Perhaps he lives alone or the missus had gone away for the weekend. He did something odd to attract police attention on the Friday.

Bit of an interesting read that may have been missed, due to the holiday beach cricket series, by Martyn van Beynen:

In the article van Beynen tells us at lot that we already know but is worth repeating to beat out the cacophony of noise from the left:

‘I don’t need to count all the blessings of living in New Zealand but today’s so-called poor would have a better standard of living than most of the ordinary middle class in the egalitarian land of milk and honey of the 60s and 70s.

Low-to-middle-income households also effectively pay no income tax. Single-earner families with two children, for example, can earn up to around $60,000 before they pay any net tax.

In addition, around half of all households with children receive more in welfare benefits and tax credits than they pay in income tax.

In international terms, the difference between the lowest 20 per cent of household incomes in New Zealand and the top 20 per cent is on a par with Italy, France and Australia. We are not as good as Denmark but better than the UK, the US and Japan.

It’s true the most wealthy 10 per cent of New Zealand households hold about 50 per cent of the household wealth but that’s the same as Canada, France and Norway.
And don’t forget the top 10 per cent of household income earners pay 35 per cent of all income tax collected, and receive only 5 per cent of all transfers (mostly superannuation).’

I await the shrill calls for a war on inequality and fairness from the left for the next nine months that hopefully will just recede into white noise as time goes on.

Isn’t great when you can forget about the values Labour was founded on for the working man and throw Health and Safety out the window so you can pander and agree with Winston Peters bottom line the re entry of the Pike River Mine. This coming from a man that holds the Government to high standards of the poor or unfortunate for the Quality of damp and mouldy state and private Rental accommodation in NZ. But now is prepared to throw away what he calls his high standard to chase his dream and achieve becoming Prime Minister of NZ. Can NZ afford to have Andrew Little and the Labour Party Govern NZ when they are more interested in their own endeavour’s before the majority of NZer’s.

    The EPMU represented approximately half of the 140 miners on the site.
    
    After the first explosion the EPMU strongly defended the management of PRC.
    
    EPMU National secretary Andrew Little (now a Labour MP) told the New Zealand Herald on November 22 2010 that there was ‘nothing unusual about Pike River or this mine that we’ve been particularly concerned about’.
    
    He then appeared on TVNZ’s Close Up to again defend PRC management.
    
    He told Close Up that underground mining was inherently unsafe and the risk of gas explosions, particularly on the West Coast, was high.
    
    While the industry was aware of the risks and took the necessary precautions, unfortunately these kinds of incidents still happened, he argued.
    
    On November 26, 2010 the Dominion Post ran an article that denounced ‘wild’ rumours that the mine was not safe. It declared that “Any suggestion of obvious or known safety lapses does not find traction with unionised staff or union leader Andrew Little.’
    
    Andrew Little’s conciliatory views toward PRC management were echoed by Labour MP Damien O’Connor. He suggested that no one was responsible for the accident and that the disaster was ‘just one of these things that the West Coast unfortunately has had to get used to over the years’.

I find it incredible but entirely the unsurprising of the automatic acceptance of the notion that unless GDP is constantly rising we are somehow doomed. The part about this story that got me is that the drunk said there was no toilet tissue available.
Nearly 49 years ago I spent a night in the Vincent Street cells. I had been exuberantly celebrating the final day of accountancy exams, and was full of piss. I recall from that encounter, which scared the living daylights out of me, that there was no bog roll available, and 49 years later nothing has changed.
A young lawyer, just out of law school, from Buddle Weir appeared for me at the rehearing of the case. Like me he is no longer a young man. It was Julian Miles!

  That was when the cops had to refer all such cases to the courts, now they can just let the drunk out when he or she had sobered up.
  One drunk in Wellington spent the night in the cells and was hauled up before the magistrate the next morning. The police officer said that the guy’s accommodation house had burnt down during the night and being in the cells saved his life. Magistrate discharged him without conviction.

However, his piece avoids any specific policy analysis in favour of lengthy personal criticism of the new President, a man with “an impetuous and narcissistic approach to government…” (along with many other perceived failings but, strangely, no perceived positives).

The Left simply cannot accept the democratic choice of USA voters. (stephieboy, please spare me another claim that Trump did not win the Presidency democratically.)

This Pike River saga seems odd to me. Now, as I see it, when the accident occurred no-one could be prosecuted, presumably even if they had been warned (by the union, for example, which was led by….). So they added some teeth to the law so that the management and directors would be legally liable should they be made aware of any H&S issues.

Now they want to waive those beefed up laws to enter the mine. They can’t use machines in this rescue (methane, no air to operate internal combustion – if there was then explosions would be a serious risk), no idea about tunnel stability (particularly near where the explosion occurred), and if something goes wrong then that proves it’s too dangerous (so rescue team are “on their own”).

And, to compound this further, they would be setting a precedent to waive the law, thus allowing unscrupulous companies to put H&S back to the pre-Pike River days.

Am I missing something here, or is this just the most nutty idea since forever?

I am gobsmacked by the left fawning over the Pike River Families. What has happened was a tragedy but this playing politics with their grief is now going beyond the pale and the MSM not calling the interchangeable leaders of the opposition on this matter is just as bad.

Are we now getting to the stage that the laws of our land can be rewritten when it is politically expedient to do so?

I was reading the comments on Stuff with regard to Andrew Little tabling a bill to remove Pike River Directors from liability arising from recovery efforts. One Jenny Kirk had the temerity to state that is was good to see someone taking politics out of it.

I don’t think that this issue has been more politicized than it has been in the past week with both Little and Peters engaging in the worst kind of politics, and using the families to gain traction. One might be tempted to allow Littles bill to pass, in the hope that it goes pear shaped and the blame could be fairly and squarely laid at the feet of these two, but I hope that English is above playing that sort of politics with this situation.

  If the proposed bill were to pass, and if there was a failed attempt to enter the mine with the loss of life then I would hold all those in parliament who voted for such legislation responsible.
  I would expect solid energy directors in the face of such legislation to resign as well, assuming that company is still responsible for the mine.

    Even if the law is changed, thereby relieving the directors of legal liability, there remains a moral responsibility. If they have a report which says re-entering the mine is dangerous, they would be behaving immorally if they permit re-entry, regardless of whether they would be in breach of the law. Not every decision in life is made solely on the basis of whether the outcome is permitted by the law.

    In addition to my earlier comments, there’s the consideration of what will transpire if the recovery does go wrong.
    
    First there will be the accident (whatever it is, probably a cave in or rock fall). Then what? Send in another team to rescue them. And if they get into trouble then what? A third team to enter. When (and how many bodies/trapped people) till time is called. At which point the media will be publishing the ‘last goodbyes’ of the trapped recovery/rescue teams as they wait to die. Or does this stop at the recovery team with no second rescue team entering.

  However Standen said this was not true. She said she requested a transfer to Hamilton but did not specify Nawton because she didn’t know the area, and she didn’t know at the time that her brother was living in the city.

  So she was happy to take the handout of several $k from Paula’s moving fund. Now she apparently wants to be paid to move back to Auckland.
  
  I’m sure, like other Hamiltonians’, we’re happy for her to leave Hamilton as long as she does it without another hand-out from the Govt.

Xero has confirmed chairman Chris Liddell will have to give up his role as a director and chairman of the cloud accounting firm in the wake of his appointment as a top aide to United States president Donald Trump.

Xero said in a statement to the NZX that Liddell had notified the company of his need to step down due to his new job as an assistant to Trump, and would relinquish his roles at Xero on Friday.

      You have this habit of spouting forth about Russian hi tech combat aircraft like Sukhoi Su 35 and perhps rightly so . But the final proof will be in actual combat condtions against equivalent Western and US ombat aircraft .Thankfully this has never happened and we can pray together never will.

Smith picking winners as the Nats. are prone to do. It was never going to work. Might in China but never in NZ. Plenty have tried right from the days of Barry Beazley in Mt. Maunganui and Keith Hay in Auckland.
Worse now with the covenants on subdivisions which will not allow these to be plonked there and with all the building regs to go with a new house.

  The only covenant that is needed on a subdivision is a moratorium, of say fifty years, on the houses becoming rentals. Nothing but nothing reduces an area to a slum quite like a lack of owner occupiers.

I cannot stand Donald Trump.

I’m talking personality, not so much politics. I can take or leave some of his policy, but I cannot stomach the man.

And I just can’t ignore the chance to take aim at a walking “free-shot”at the affluent target who talks effluent. (In fact, he evokes the same feeling I get when I use a public restroom and the toilet seat is already warm. It kind of grosses me out.)

Your definition of obscenity may be what Donald Trump is accused of getting up to in a hotel in Russia.

Mine is about the money he’s worth, which is more obscene than any random combination of adult orifices could be.

I don’t hold with billionaires. The news this week that two New Zealanders are worth as much as the poorest 30 per cent of adults here is, then, not thrilling news to me. We’re told that Graeme Hart is worth $9 billion and Richard Chandler $3.8b, and Finance Minister Steven Joyce seems to think that’s a good thing. Just so long as everyone gets the chance to get that rich, he says, there’s nothing to worry about, besides which lots of people are motivated by such trail blazers.
