Yesterday the Court of Appeal released its decision on two ‘second strike’ murders upholding High Court decisions in both cases that life without parole (LWOP] would have been manifestly unjust. See:

At [134] the Crown tried and pull David Garrett’s foot from his mouth regarding his third reading speech, but the judges pretty well ran with it where David said LWOP was intended for the worst cases only.

In Harrison the judges agreed that LWOP would be manifestly unjust because the first strike crime was the least serious of the ‘strike’ crimes and its circumstances were at the low end of seriousness. The murder was not the most brutal given that a 13 minimum was imposed. The judges declined to treat previous serious offending (prior to ‘strike’ legislation) as a reason favouring LWOP.

In Turner the judges seemed to be swayed by Turner’s mental health issues. They also said it was nowhere near the worst type, despite upping the minimum non-parole term from 15 to 17 years. Turner entered an early guilty plea.

All in all disappointing decisions for David Garrett and the Sensible Sentencing Trust).

Presumably the Crown will try and take both cases to the Supreme Court. I think the Harrison case is now a dead duck. In Turner the issues would likely be the extent that mental health issues mean that LWOP is manifestly unjust, and the magnitude of brutality required if LWOP is not to be manifestly unjust.

So where does this leave the other three cases? In Kingi the murder was brutal but early guilty plea, remorse, mental health issues and victims’ attiture resulted in 13 years minumum. LWOP or even a 17 year minimum were regarded as ‘manifestly unjust’. I doubt that a Crown appeal would be successful in the light of the Turner decision.

In Herkt, murder was less brutal than Kingi, Herkt had mental health issues and majority of victims while supporting a long non-parole period did not support LWOP. Again I doubt an appeal would succeed.

In Eruera, there was a single knife blow resulting in loss of blood and death. However surrounding circumstances were just sufficient to engage s104 meaning 17 years minimum. Provocation and absence of brutality tipped the scales against LWOP. Eruera was different from Turner, Kingi and Herkt in that there was provocation and significant less brutality. Again I doubt that an appeal would succeed.

LWOP for a second strike is now flat on the canvas gasping for breath. It now seems that an offender would need to be not mentally ill and to carry out a really brutal murder for a ‘second strike’ LWOP to stick.

In one instance, top Clinton Foundation official Doug Band lobbied Clinton aides for a job for someone else in the State Department. In the email, Band tells Hillary Clinton’s former aides at the department — Cheryl Mills and Huma Abedin — that it is “important to take care of (redacted).” Band is reassured by Abedin that “Personnel has been sending him options.”

Picking up on Left Right and Centre’s comments at the end of GD August 10:

Cyclist Linda Villumsen has missed a medal in the women’s time trial at the Rio Olympics.

The 31-year-old finished sixth on the hilly 29.9km course which was made even more difficult by rain and wind that hit the city.

“It was pretty rough conditions,” Villumsen told NZ Newswire.

“There were gusty winds, and rain, especially on the descents.”

…which were the same for all the other competitors

Villumsen, who missed out on bronze by 1.8sec at the London Olympics four years ago, said she felt flat right from the start.

“Not real good – from the beginning, I was a bit tensed up. Usually you’re better after 10 or 15km but today it just didn’t happen.”

The world and Commonwealth champion, Villumsen recorded a time of 44 minutes 54.71 seconds and 28.29sec behind Armstrong who won her third consecutive gold medal in the event.

The Kiwi was fifth through the first time check at the 10km mark, almost 18 seconds behind Armstrong and held that position at 19.7km.

She had targeted an Olympic medal to add to her successes in the event but ended almost 17sec behind Dutchwoman van der Breggen in bronze.

Sounds like she did a “Hamish Carter, Sydney 2000”. It happens. Good luck to her taking it on the chin, re-grouping and coming back in 4 years time..again. “That which does not destroy you makes you stronger” (Friedrich Nietzsche). And that is why sport is life…

Nice to see Nick Leggett fighting back against Andrew Little:

Porirua Mayor Nick Leggett believes there is a “purge” going on within Labour to rid itself of members considered “right wing.”

He takes issue with Labour leader Andrew Little’s description of him yesterday as “right wing” and says he is a “moderate.”

“I supported and continue to support a capital gains tax as a policy. Andrew Little doesn’t. Who is more right wing?” he said.

“I believe I’m of the centre-left, however within Labour I have always been a moderate,” Leggett told the Herald.

He said he was “pro-enterprise” but as mayor of Porirua, he had also been a strong advocate for social issues in the city.

“It’s a sad day for a party that once regarded itself as a broad church. It shows that a purge of the few party members left (and MPs) regarded as “right wing” is well under way.”

And Leggett is calling the Labour leader out of his porkies:

Little also said Leggett’s campaign was being run by an Act identity and that his campaign was being funded by “right-wingers.”

Leggett said his campaign manager was Michael Gregg and he was not a member of any political party.

“My campaign committee has people on both the left and the right – as you would expect in any broad-based local government campaign.”

– What qualifies as ‘the provinces?’

@ Captain Mainwaring – the other underlying message here is that a Labour government will once again try to keep unemployment low by fattening up the public sector until it becomes morbidly obese. These won’t be “real” jobs created by businesses; they will be political jobs, funded by the already long-suffering taxpayer. Be prepared for the top tax rate to head north of 45%.

@ Northland Wahine – indeed; all credit to Fiji, who are now on track for the country’s first-ever Olympic medal. The New Zealand side battled hard, but came up short. But what a day tomorrow promises to be for our Fijian friends.

I suspect we are soon going to hear what’s really been going on in the New Zealand Sevens camp, why Kurt Baker was omitted from the Olympic team, wh Ardie Savea opted out (and wasn’t that, with the benefit of 20/20 hindsight, a great decision), and why what has been the most dominant team in world sevens has become also-rans this season. The NZRU needs to ask some very pointed questions.

Our fractured Criminal Justice system . Case in point , a neighbours NZ born girl, raped. The offender a person of mid east extraction. Police charge rapist with sexual assault. The punishment ,home detention, as the judge said it was the mid eastern persons first offence. The victim, while in the court precinct ,awaiting the rapists sentence was told to harden up by a court official. To make it even worst the rapist didnt even turn up for sentence. Finally after a lot o f sorry,s the sentence was put back 2months,with no penalty for failing to appear. When defendant appeared, after two months judge gave the defendant another month to sort out his home detention abode.,or else. At all times the defendant, was treated,much ,much ,much better than the victim. One can’t help but think ,the defendant from the religion of peace,seems to have had a lot more sway, over his accusers. Maybe even with our Criminal Justice system, being on life support ,Sharia Law perhaps will become an option,for our bleeding heart officials.

I still believe having a weak opposition does no favours to our nation. The government should always be challenged to do better, perform better, deliver the best results. This isn’t going to happen and hasn’t happened in the last 2 elections. You shouldn’t be the government by default. You should be because you the best for our nation, and not just what’s best on offer.

Do you mean that there were not 4 witnesses?, so that the defendant was probably not really guilty.
That a woman’s witness is only half of a man’s? Probably including any female Dr., or nurse.

Too many mistakes and the questions need to be asked of the NZRFU rather than Tietjens and the team. It became clear early on that the NZRFU was interfering and not fully supporting the 7’s team putting Tietjens in an unenviable position.

The voters don’t have a lot to choose from in New Zealand.
– Democratic socialist National (pro-wealth but high borrowing, high spend)
– Socialist Labour (anti-wealth, higher spending, higher borrowing, higher taxation)
– Greens (eco-fascist high-control, anti-capitalist, statist, anti-human)
– NZ First (a reactionary one-man personality cult that is for people who don’t like the government but won’t vote for Labour or the Greens)
– The rest add up to 2.6% of voters!

Apart from (ACT? Again, a one-man show?), there is no “fiscally responsible, small government, get-out-of-my-life, take personal responsibility-promoting party” to vote for.

Let’s face it. New Zealanders love BIG GOVERNMENT (so long as it pays National Super, doesn’t put a capital gain on property and doesn’t have death duties).

There is a lot of anti Clinton posts going around these days. America is a large country with a diverse population and dynamic political landscape, historically populated with some of histories great statesmen.

The likes of both Roosevelts, Lincoln, Eisenhower, Kennedy, Washington and Reagan (who history treats much kinder in hindsight) are now to be joined by one of 2 candidates who are, depending on who you listen to or which website you click, are flawed at best or downright dangerous at worst.

I’ve never been entirely comfortable with the idea of Clinton running, in the same way that I was uncomfortable with G.W. Bush Jnr running. It gives the appearance of a dynastic nature to US politics and almost gives a case for the emergence of a ruling class structure with the US and a way to circumvent term limits.

That being said, there is no circumstance that would allow me, if I was eligible, to vote for Trump. The rhetoric, the casual attitudes that have seen him claim that he could shoot a man in Times Square without repercussions, the aside to second amendment supporters to take matters into their own hands against Clinton (Like “who will rid me of this turbulent priest”, but without the benefit of classical language) have shown that the Broad Church of US politics has a very dark underbelly. When you advocate, even as a supposedly humourous aside, that harm should befall your political rivals, you cross a line.

That a person running for Head of State could so casually cross that line, without fear of repercussion, or without the sense or knowledge of possible repercussions, shows Trump to be manifestly unfit for the job. Clinton, for all her faults, is the better of the 2 candidates, and the GOP will be engaging in some serious soul searching in the next few years.

He has brought numerous suits against especially the Clintons but also other familiar ones like the Obama, Mark Zuckerberg , NSA . Another case of where a ‘licenced’ real estate agent is dodgy, and where he states he also said he knew of ‘countless cases of unethical behaviour among his peers’. In other industries such as the finance and security where licencing is mandatory, the dodgy ones invariably slip through, and it is as though being licenced gives one cover to be ‘wide boys’.

I have been forecasting to my friends, for some months, that NZ would be lucky to win a medal in the 7’s at Rio and that Rio might be a last gasp for NZ 7’s as once a sport goes Olympic we will see major sporting powerhouses look to increase their presence eg USA, Russia, China. In recent times our 7’s performances have been falling off and other nations are emerging such as Kenya, Japan etc.

Act is a a man show because of its lack of support .
Some of this is due to the historic loss of direction the party suffered under prior leadership like john banks parachuted in despite his conservative politics being at odds to the party original manifesto.
Under MMP a thinking economically right voter would vote act party as a matter of cuse in an effort to shift national towards the right economically
National is a monolithic party that does not represent most as it try to represent all on the right.
This is displayed the tension between the conservative and liberal right on here.
Yet our political landscape doesn’t represent this difference in voter preference because of nationals monolithic nature.
We need both strong liberal right and conservative right party’s for our political system to function at the optimum level of democracy.

I am thrilled to see that emails are coming out which appear to have a smoking gun linking Hillary Clinton to receiving money for favourable treatment by the State Department when she was Secretary of State. Basically since Bill left office the Clintons’ have been using the Clinton foundation and the State Department to provide favourable treatment for companies and countries who in return donate large amounts of money to the Clinton foundation and/or pay hundreds of thousands of dollars in speaking fees to Bill Clinton.

It has been widely reported that the Clintons’ have received $150 million in speaking fees since Bill left office. They must have been really great speeches or they were payments in return for favours granted by the State Department when Hillary was in charge.

This appears to be a national scandal of corruption at the highest level and I would think that any reputable news outlet would be all over this. However I don’t expect the mainstream media to make a firestorm of this because that would divert them from their true mission of electing the Democratic candidate for President of the United States and running down the Republican candidate.

Teitjens was offered Smith (B) and others, but not on his “take it o lerave it” terms. Smith and Savea et al got it right. Other Nations were not Teitjens-like dogmatic.

Moreover Scotland, Wales and England combined to make one team.

But in case folks failed to notice, it was a finally a case of a few wobbly and failed conversion attempts that sealed off any chance of a medal. Not saying gold. Excellent result for “F one J one” if ….. F1J1wins.

Time for the Teitjens to hand over to Rushie or DJ.

The whole case was suppressed, and the reason why i am blogging on it, it happened to one of our neighbours children. i have only been giving a brief outline of the happenings, it could have been mirrored with what happened recently in the USA ,when the rapist there got around 3-6 months,even though the case called for justice,same thing here except even worse.

So what happens to the poor people that failed their course’s after using the student loans system to fund them,Andrew’s policy can only fit people people with skills that are needed in regional public service.On top of this after wiping their loans they win again as they are paid by the taxpayer,so Labour manipulate the public service like the always do by loading them with extra starting they will say they created when really the money they will have paid out is no different to social welfare

To tell the truth I haven’t seen a whole minutes coverage of the Olympics yet. I don’t watch NZ’s attempt at reporting ~~opinions~~ news and don’t have Sky. I havent missed it one bit.

However I did watch Guppy get 3 for 11 in the cricket last night which conveniently finished right before bed – aided by some poor umpiring.

Replays showed Australian umpire Paul Reiffel and English umpire Michael Gough dismissed four Zimbabwe batsmen who should have been given not out

I see my 9:00 am post has already received 4 down votes. Now I know that coming to the internet for intelligent debate is a bit like going to McDonalds for fine dining, but if you have chosen, as is your right, do down vote my post, I would appreciate it if you could follow up with reasons why.

It’s fanciful thinking, but this is a general debate thread. I’d really like to see a position justified with debate, and examples, and not just rants of “Crooked Hillary”.

I have outlined my reasons as to why Trump is not suitable for the role he is chasing. If you think Trump is more suitable than Clinton, then do us all a favour, and point out the reasons why.

We already have creeping socialist employment in Local Government.

Tauranga Council now want to spend $69,000,000 on new Council offices for the creeping employment role.
Yes, right in the centre of the City once they have pulled down the old mould infected building.
Instead of cleaning the so called mould, which few have been allowed to see.

The Councillors are vacillating because of the local Council elections but the Executive (read employees), after the failed Wellington CEO took over, after the previous failure who went to Auckland, will push this through.

There is plenty of available land close to the city centre where a leased building, with car parks for all, on bus routes, can be gainfully employed, but no the staff are the leaders.

It makes no different who the Councillors are, the executive wins as Councillors can be bounced off at the next election.
Employees cannot be bounced at any time and can continue to grow exponentially.

The sad fact is that it has been a generation since New Zealand last experienced a recession (early 1990s) and even longer since the share market crash of 1987.

A Kiwi would have had to have been at least a graduate or a young home owner (say, aged around 25) in 1992 to remember the recession. That would mean that they were born around 1967, making them about 50 today.

The Chinese of the same generation have never known economic bad times. Since the early 1980s, China (like Japan from 1950 to 1992) has only experienced “unending” economic growth. No Chinese aged less than 55 would have adult memories of recession.

Maybe this is why so few property owners in Auckland believe that there is a better store for one’s wealth than in real estate. “Property only ever goes up, right?”

As for myself, I lived through the Japanese real estate crash of the early 1990s. I saw the companies burn. And I feel that same atmosphere that preceded the crash, here in Auckland today. (Of course, I have no idea when any property correction will come.)

What I do know is that when it comes, people will look at each other in disbelief and exclaim, “How could we have been so stupid!?”

It’s fanciful thinking, but this is a general debate thread. I’d really like to see a position justified with debate, and examples, and not just rants of “Crooked Hillary”.

I have outlined my reasons as to why Trump is not suitable for the role he is chasing. If you think Trump is more suitable than Clinton, then do us all a favour, and point out the reasons why.

OK, I’ll have a go. I didn’t down vote you, and in the main I agree with you. Can’t see, if I was American, that I would ever vote for Trump. Not primarily for his hodge podge of silly unworkable policies but more because he seems to have no coherent strategy.

But this comment by you I will have a go at:

The rhetoric, the casual attitudes that have seen him claim that he could shoot a man in Times Square without repercussions, the aside to second amendment supporters to take matters into their own hands against Clinton (Like “who will rid me of this turbulent priest”, but without the benefit of classical language) have shown that the Broad Church of US politics has a very dark underbelly. When you advocate, even as a supposedly humourous aside, that harm should befall your political rivals, you cross a line.

I call “bullshit”. Is a standard left-wing tactic to portray all those on the right as variations of Pinochet. I heard the so-called “assassinate Hillary Clinton” suggestion. Commentary is just left-wingers faux-fainting over a rambling piece of…Trump nothingness. And joking about what would happen if he shot a heckler? Hell, Ronald Reagan outlawed the USSR and gave the order to commence bombing 😉 You do know that whining complaints about”micro-aggressions” are the sort of thing that drives support for Trump, don’t you? Just as Brexit voters got fed up with whining left wing “experts” and “commentators” telling them they were “nothing but racists”?

Many people are tired of being told what to think, say and do by self-appointed ideologically-driven “experts”. That explains Trump’s success thus far…

In answer to Chuck Bird and Rachael Memberry from yesterday, the killer of Hoglin and Pakkonnen was George Huia Foley. He confessed to the crimes on his deathbed, and told his cousin the body of Heidi would never be found. The police will no doubt explain how he was eliminated as a suspect. The fact remains that David Tamihere had no means to place Hoglin’s body at the crime scene, all forensic analysis determined he died there, 74 kms from Crosbie’s clearing.

Just because thickos are spouting stuff ….. does not mean that they’re always wrong. I’d bet none of this is illegal, just like it was not illegal when some Clinton Foundation donar suddenly turned up as a National Security advisor, with the others looking at eachother and asking where he came from and what expertise he had. Fortunately that was so blatant that he could be given the boot, but it was a poor look.

And then there’s Chelsea’s various “jobs” that have enabled her to compile a fortune in the tens of millions by age 30 – including a stint as a TV “journalist” that saw her with an annual salary of $400,000. That also only lasted a while, raising eyebrows among others at the company (NBC?) before she vanished again – with the money.

Nothing illegal there either – and I’m not being sarcastic. But if you don’t think all that is corruption – and it’s just two among many, many examples, then you’ve got your head in the sand. You can still despise Trump, and the GOP if you want, without being stupid about what Hillary and company are.

It’s been a long time since spinners bowled us to victory on the last day of a test match, so that’s a good sign with a tour to India coming up in a couple of months. Sodhi and Santner will only get better from a big workload, and Guptill’s ability to get turn and bounce from a lifeliess pitch was a bonus.

But yes; the umpiring of Paul Reiffel especially on the final day was below the accepted standard. The wicket of Ervine right on the stroke of lunch was a killer blow for Zimbabwe when there was clearly daylight between the edge of his bat and the ball. Santner’s LBW dismissal of Tiripano was pretty dodgy as well.

I blame the ICC and the DRS, not individual umpires. The umpires on the ICC’s panels have all got there by being excellent decision-makers. But when they get to the top level they lose their edge, mainly because the DRS second-guesses so many decisions. In all honesty, the game would be far better if the ICC restricted the use of the DRS to adjudicating on run-outs and stumpings only, from the static side-on cameras. Ditch hot spot, ditch real-time snicko, and let the umpires use the decision-making skills that got them to the top level. Sure, there will still be the occasional dodgy call, but cricket is an inherently human game played by humans who are prone to err; whether players or umpires.

Who you know has an effect on your prospects this is true in any society.
Trump benefited from his father connections and his children benefit from their fathers influence .
The same can be said of the Bush dynasty.

I read somewhere (recently) that the Clinton charity only disperses approx 15 % of what is received for charitable purpose. 85% is used to run the foundation – perhaps some of that disappears or is used to further the Clintons personal ambition / agendas. Hence the corruption angle.

New Zealand has strange border control.

On the one hand, an English entertainer is booted out of the country for not meeting some declaration requirement. On the other, an Indian who raped a 14-year-old girl is allowed to live in NZ because he could not find work on being deported to India. Where the hell are the feminists on this case? They probably won’t say boo because the offender isn’t a nasty white.

Who is the Immigration and Protection Tribunal that makes final decisions on who is in, and who is out? Apparently the chairman/chairwoman is always a district court judge. Perhaps all the tribunal members must be lawyers. If so, why?

After Rome became an empire, things began to turn sour for the denarius and, by extension, the Roman economy. Base metals, such as copper were blended in with the silver and so even though the coin itself weighed the same, the amount of silver in it became less and less with each successive emperor. Throughout the first century the denarius contained over 90% silver but by the end of the second century the silver content had fallen to less than 70%. A century later there was less than 5% silver in the coin and by 350 AD it was all but worthless, having an exchange rate of 4,600,000 to a gold solidus (or nearly 9 million to the original aureus).

The economic chaos the hyperinflation of the denarius had on Roman society was very real. The population of Rome reached a peak of about 1 million inhabitants during the first century BC and maintained that level until nearly the end of the second century. At this point it began to slowly decline throughout the third century and precipitously throughout the fourth. By the fifth century, only about 50 thousand people remained.”

Not that I’d normally bother coming to the defence of stephieboy (who is on my permanent do-not-engage list, btw), but maybe it is that “repulsive Anglosphere” he – and the rest of us for that matter – swims in that skews his judgement?

Just to clarify – Soviet communism = bad and a distortion of the virtues of Mother Russia…except during the Berlin Airlift and building the Wall, and the Cuban Missile Crisis? Confusing stuff, this geopolitics, especially coming from that Anglo-Saxon perspective…

Stuart was making stuff up on the fly,( barking at passing cars) His regional program to employ university grads is now a national program as Stuart was saying about teachers in Auckland been subsidised, (more barking at passing cars).Just admit that you intend to inflate local goverment with all your make work bullshit! ###Then he admits that he has not costed this out###, (more baking at passing cars). The tribunal’s decision says that shortly after the family was granted residence, when the man was 14, he raped a girl in an area of bush behind their local temple.
