Jack5 Re Sanitarium and Ngai Tahu – as long as the profits are being applied to charitable purposes (this included religion), what is the problem? Sanitarium does pay net GST, so it does pay some tax. If Sanitarium had to pay tax on profits, then every trading activity ancillary to charitable or non profit organisations would need to pay tax on their profits (eg Vinnies, school uniform shops etc).

Another recent personal cop story that I wasn’t going to bother with but anyway . . .

A week back I’m getting ready to cycle to shops – ready to pump up slow leak back tyre.

Cop on foot walks onto property. Looking for someone on a scooter or taken a scooter and gone down a drive – something.

I reply – ‘shit, I wondered what it was I’d done when I saw you’.

Funnily enough – I own a scooter and funnily enough cop can see it, only because I’m heading out. Perfect timing.

All the way through this two minute event – I’m on my own property, doing nothing wrong, relaxed, talking away, trying to be affable – but the way the humourless cop is looking at me – I feel like I’m trying to talk my way out of a ticket or something.

Cop seems unsure of himself. Pauses a bit before asking ‘mind if I take a look’ (at the scooter). ‘Go for it’.

And all through this thing I’ve got the bloody bike pump in my hand and the cop doesn’t look at me but his gaze never strays away from the potentially ‘life-threatening weapon’ I’m carrying. He couldn’t have timed it any better – I was about to pump the tyre when he came along. His stare made me want to slowly place the pump on the ground, put both hands up and step away. Before getting tazered.

It lasted two minutes because I yapped about how ‘well-behaved’ and ‘respectable’ the young locals are. Otherwise in his mind he could’ve shot through in maybe thirty-forty seconds. Old Mr Stone Face Plod eh ? Not so much as a howdy he ha ho how’s the day going ? I suppose that is quite unusual to find the legal occupant on their own property with their own f&%king registered vehicle, eh mate ? No wonder people don’t bloody like them. All the personality of a baggage self check-in.

Setting the record straight – Manumpty is well known for lame smears and repeatedly making things up.

I have no intention of joing the Labour Party or any political party. I have no intention of putting myself forward as a candidate in 2017 – and I think there’s no way Labour would consider me as a candidate even if there was a vacancy here (which there is no sign of), apart from other things I’m probably from their least sought after demographic for candidates.

Manumpty is either wildly guessing or being deliberately malicious. His past record suggests at least partly the latter.

Sure I’ve put myself forward as a candidate on two occassions, 2011 and 2013. On both occassions that was for particular reasons and very worthwhile and interesting experiences, getting to meet and know better politicians I wouldn’t otherwise have had any contact with. But that’s in the past.

And I learnt a lot about the practicalities of our democratic system, including the difficulties of going against the status quo that is dominated by media selection. A very useful insight.

I’ve written about some of the successes and positives of Andrew Little, that’s all. And about some of the negatives and challenges facing Little and Labour.

I hope that Little does succeed in rebuilding Labour (but it will take much more than him).

This doesn’t mean I support Labour over any other party. I support all parties being as useful and as strong as possible, because that’s good for our democracy, for our Parliament and for our country.

Manumpty seems to prefer a one party state but there’s no party in New Zealand that fits his fringe ideological wishes. So he seems to have nothing to do but continue to be an armchair smearer.

I’ll keep promoting positives in politics and also hold to account those who try to smear – and if they contnue to do it then it will prove it’s malicious.

Ngai Tahu a southern tribe? No,they were foreign violent invaders from the north .It’s beyond me why the taxpyer is rewarding that violence with reparations and relativity clauses. The National Party has a lot to answer for.

As a charity it pays its directors and executives extremely well.

The problem is they are in a privileged tax position over competitors. Why should a religious group and a tribe get privileged tax treatment?

Why should charities operate tax free at all? Are they in business to distribute charitable donations or to compete on a tax advantage?

Why shouldn’t Ngai Tahu, for example, use the shareholder and tax-imputation regime to distribute its earnings like other organisations?

How do Ngai Tahu’s tourism competitors feel about its charity tax position? How do Sanitarium’s competitors feel about Sanitarium’s.

A review of the charities and tax regime is overdue.

Are you sure, Kowtow? As my cousins tell it, Ngai Tahu fought off Te Rauparaha. They were led by the very capable Tuhawaiki, Ngai Tahu’s chief (1835-1844). Based at Ruapuke Island in Foveaux Strait, he was known to southern pakehas as Bloody Jack. He repeatedly chased Te Rauparaha out of Marlborough in the 1830s.

Yes EAD. I warned the sheeple a few weeks ago about the BDI crash but as usual they just continued their bleating in their green green meadow of deluded peace and happiness.

For the sheeple who don’t get it, the BDI is the best lead indicator you can get of the health of the global economy. It led in 2006 and it’s leading again now.

11 March and 11 May. Put those dates in your calendars. And if you’ve got any positions in the markets, make sure they’re short. But preferably, get out now.

I’ve seen predictions of imminent financial collapse for years here.

Crash predictions seem to be as frequent as weather predictions but less reliable. Eventually someone will get them right, but the probability is very low.

Putting specific dates on it is as bad as Ken Ring predicting major earthquakes.

Any other Kiwiblogger agree with me that if the voter turnout is less than 45% in the upcoming Northland by-election, and the vote is split with the possible standing of a Conservative Party candidate, and the likely standing of an Independent candidate from the disaffected, determined and well-organised revolting Mangawhai Residents and Ratepayers Association, (campaigning for the REPEAL of the hideously undemocratic Kaipara District Council Rates Validation Act 2014) – then the return of a National Party MP cannot be taken for granted?

For the public record, if one of the gutsy Mangawhai rates strikers does stand as an Independent candidate in the Northland by-election, I will give them my full support.

Using the electoral process to make a FUSS about the issues can be VERY effective.

The democratically disgusting Kaipara District Council Rates Validation Act 2014, and the circumstances leading up to it, in my opinion, need the public spotlight on FULL – because citizens and ratepayers all over NZ need to realise that what has happened in Kaipara – could happen to them.

What do you say to that gutless/anonymous IGM?

What does the ‘Tax Payers Union’ have to say about the Kaipara District Council Rates Validation Act 2014?

Nothing wrong with a testable prediction Pete. We will see on those dates whether the prediction was correct or not.

Not like that branch of “science” that can’t do that accurately. The branch that can’t even agree on what the predictions are, much less when they might occur. But the answer is agreed by all the “scientists”(tm) that the “answer” is more taxation (much more taxation).

Jock Anderson is right in that the person looking at the case needs a “clear head” without predetermined conclusions about the outcome, something that the tax lawyer failed miserably at when she didn’t get the desired conclusion from Binnies report.
All the “clear heads” that have looked at the issue of guilt or innocence in this case so far have come up with one conclusion!
And that Stupidone was “not guilty”, a substantial miscarriage of justice and innocent on bop.
Time for you to get over that and stop trying to pretend that Robin is innocent as he most certainly is not!

Given that the Mangawhai Residents and Ratepayers Association is based within the Northland electorate, I for one, would not underestimate the potential electoral support if one of their members does stand as an Independent candidate.

In my view, in terms of having a proven track record in defending democracy and exposing corrupt conflicts of interest – this organisation is not to be taken lightly.

Should all be rather fascinating!

Looking forward to the upcoming Northland by-election, and the upcoming Parliamentary questions and debate on this matter.

So the lefties are going to be out in force asking the critical questions of the day like when was Key told about Sabin resigning, was it via text message (and did Rachel Smalley approve of the PM reading the text), what was Key wearing at the time and was it fine weather or raining.

Or they could question and challenge the governments policies? They might have heard one has been recently announced.

The Mangawhai ratepayers have every reason to be totally peeved over the way they have been treated and National have been poor in responding to yet another shocking local government cockup.

The wastewater ballsup could become a big issue in any by-election and the fact it is a by-election anything could happen.

You can trace this whole sordid affair back to Agenda 21 and the governments obsession with controlling everyones wastewater unnecessarily.

Re Mangawhai – An ‘independent’ candidate will probably gain support from some Mangawhai residents only. The whole Mangawhai situation boils down to who pays? It is either the local ratepayers, the taxpayer or the lenders. It will not be the lenders – they lent in good faith and can exercise their security under the law (whether or not the validating legislation was passed). So it boils down to the taxpayers (on the grounds perhaps that the validating legislation ought not to have been passed and/ or the Auditor General’s office goofed) or the ratepayers.

So the issue becomes one of whether an ‘independent’ pro-Mangawhai candidate can pull enough votes off National to let Labour win the seat. The Greens could advise their followers to vote Labour, but then the Greens do not like Epsom style tactics do they?

If indeed the Audit Office would likely to be held negligent by a court, the Government could pre-empt any court decision by (say) offering 50 – 75% compensation (ie money payable straight to the lenders). But then this would draw the ire of the taxpayers union and taxpayers in other parts of the country. The only Labour response would be that the law be changed denying the lenders their security, but this would then have an adverse effect on the ability of the Government and local bodies to borrow at a reasonable rate.

Presumably the only action that would satisfy Penny is to deny the lenders their ability to enforce their security. However this is not an option for NZ Inc.

The you considered some salient facts.This is not 2009 but 2014 .A compensation claim continues to elude Bain not for won’t of trying .Different considerations,conditions and tests are involved in the claim .
The commercial lawyer fell short on that score by giving Bain an easy and indulgent ride and pedermining the outcome in his favour.

For example Bain claimed he couldn’t remember the details of the crime scene because of amnesia induced acute stress reaction PTSD or whatever .Then tells the commercial lawyer in some depth that he could in fact remember .No attempt to query this blatant inconsistency

Another the commercial lawyer accepts Bain’s explanation that the bloody gloves were likely worn by Stephen as part of some pretend play .Do you and his cheer squad seriously believe he should receive compensation when he comes up with that kind of rubbish and Binnie nodding approvingly .

These are but two examples of Binnie ‘s partially towards Bain that included a total unwillingness to seek out what other witnesses
had to say to either corroborate or rebut..Naturally in this frame of mind the commercial lawyer can readily conclude that the broken glasses as ” unexplained ” or even that sex with a goat malarkey

And you try to tell about the Tax lawyer’s bias .

The truth is, one act of dishonesty must in turn result in ever more acts of dishonesty.

What with dishonesty, and irresponsibility, being basically the same thing.

Along with the fact that both dishonesty, and irresponsibility, are “circular” in nature.

With honesty, and responsibility, on the other hand being both “straight'”

A further truth being, that everything that is circular in nature (i.e. dishonest/irresponsible) must eventually brings about its own inevitable demise.

As of course, one is forced to eventually reap the results of what one has previously sown.

And so, as I said, collapse IS “baked into the cake” – it is just a matter of when, not if

What with reality being as completely unavoidable as it is..

So, prepare you must. For change this way comes.

Penny – Back in 2002, Helen Clark spilled the beans about a Serious Fraud Office investigation concerning another political party. She had been briefed under the ‘no surprises’ rule and to publicise it was totally wrong.

Assuming that John Key has been briefed under the ‘no surprises’ rule of any investigation concerning a MP National or otherwise, it would be quite wrong for him to publicise this or do anything anything that would have the effect of publicising it.

Therefore, unless there are appropriate developments in the meantime (eg a court appearance without name suppression) all John can do is decline to answer any questions on this. Once developments have occurred he can then admit when he first heard about it. He can also claim a constitutional convention on this (Helen Clark was rather adept at re-fashioning constitutional conventions).

Bain requires “exceptional circumstances” in relation to his compensation claim.
One that Binnie offers is that the house and evidence it possibly contained was burnt to the ground.
But, apparently, that was with the agreement of David Bain, which I don’t think Binnie points out.

Instead of nitpicking Binnies interview with David for inconsistencies try using an evidence based approach and consider the evidence piece by piece and it’s probative value. Given that it’s a circumstantial case and you can make cases for and against then you have to consider all possible outcomes and not just the one that fits the predetermined “guilty” mindset. This is where you and the crown fall over Stupidboy by starting with a conclusion of “guilty” so then make all the evidence point back to the predetermined conclusion. This is not the approach to take, the evidence needs to come first.
The probative value of the glasses and gurgling etc is 0 Stupidboy when the evidence is properly considered. Ask yourself “how likely is it that a non short sighted person would require a pair of glasses that are adjusted to fit Margaret’s astigmatism would be required by the killer to shoot 4 people at point blank range” and “how likely is it that the lens found underneath folded clothing and the ice skate boot under the bunks was involved in the fight with Stephen”?
The crown case around these is simply conjecture and the evidence in fact says that it is highly unlikely.
Once you go through these steps you soon realise that there is no case against David.
However if you add a step involving the likelyhood of Robin being “murdered” based on the evidence then likewise there is only one conclusion and that there is no evidence consistent with his death being anything other than suicide.

The house was only in a position to be burnt down as it had been released to the family prematurely. Items such as the bloody footprints had not been uplifted. Whether or not David had consented is irrelevant, the premature decision to release it to the family without uplifting crucial evidence is a cock up on the part of the police and resulted in the evidence going up in smoke with the house.

I reads Grace’s submission and so-called evidence, and frankly was underwhelmed. There appears to be a personal vendetta driving this so-called proposal from Grace.

In civilised societies, artists and intellectuals are the windows to the soul of the country, and to condemn an artist such as Eleanor Catton for commenting on what she perceives to be morally and artistically bankrupt political leadership is to surrender any claim to civilisation. Her involvement with Green Party politics is a logical extension of her convictions. She may be wrong; what she said may have embarrassed this country, but she was right to say what she did and I support her right to do so.

The Parliament document reporting back to the House on the petition of Grace Haden mentions no voting statistics, unanimous or not, so to indicate Mike Sabin did anything in particular that “knocked back” the petition is an opportunistic corrupt inference.

While you are fully entitled to view the OAG as “USELESS” if that suits your purposes or prejudices, you go much further and claim that such decisions “help prove why NZ needs an Independent Commission Against Corruption.”

That could be seen as a fairly strong, implied accusation of corruption in the OAG. Who do you understand was involved in, or responsible for, the specific alleged corruption in the instance you have referenced?
